ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
4. Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority.
5. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
6. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
7. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
8. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
9. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General
1. The premises licence holder shall implement written procedures covering sales of
alcohol and stewarding of the premises during licensable activities. The premises
licence holder shall ensure that selection, training, instruction, supervision, and
disciplinary matters are exercised by the General Manager or Corporate Manager
on behalf of the premises licence holder.
The prevention of crime and disorder
2. The premises licence holder shall arrange for adequate stewarding arrangements
to be in place for licensable activities or events.
3. Suitable and sufficient training shall be undertaken by staff.
4. The Police shall be notified prior to licensable events or activities taking place
where 100 or more persons are anticipated to attend at any one time.
5. The premises licence holder shall risk assess licensable activities or events and
use or employ SIA registered door supervisors at all times where the risk
assessment identifies a need to:
• Prevent the admission, and ensure the departure from the premises, of
drunk and disorderly persons, without causing further disorder;
• Keep out excluded individuals (subject to court or Pub Watch banning
orders);
• Search and exclude persons suspected of carrying illegal drugs or
offensive weapons; or
• Maintain an orderly queue outside of the venue.
6. When door supervisors are required there shall be a minimum of two for the
duration of the relevant licensable activity taking place. Where five or more door
supervisors are used, at least one shall be female.
7. The premises licence holder shall provide a means of two way communication to
report incidents between the premises management and the Police.
8. The premises licence holder shall ensure that alcoholic drinks are only available
for consumption from plastic vessels or toughened glass. No beverages shall be
available for consumption from glass bottles. Where glass bottles used for
decanting drinks, shall be retained or disposed of on the premises.
9. No customers shall be admitted, or permitted to leave the premises, whilst carrying
opened or sealed bottles or glasses.
10. The consumption of alcohol shall be restricted to the areas identified on the plan
attached to the premises licence as Annex 4.
11. The maximum permitted occupancy of the licensed premises shall be restricted at
any one time to 250 persons, unless any alternate maximum has been set via the
Regulatory Reform (Fire Safety) Order 2005. Stewards or door supervisors shall
be advised by the premises licence holder to monitor and enforce the capacity
limit.
12. The premises licence holder shall ensure that a secure deposit box is kept on the
premises for the retention of confiscated items and shall ensure that the Police are
promptly advised of any items which require safe disposal.
13. The premises licence holder shall ensure that public information notices about
crime and disorder issues are displayed at the request of the Licensing Authority
or the Suffolk Constabulary.
14. Any restrictions on the admittance of individuals according to age, and conditions
of entry, shall be displayed on or immediately outside the licensed premises.
15. The premises licence holder, or their nominated representative, shall participate in
the local Pub Watch or Nightsafe (or equivalent scheme), where such a scheme
operates in the locality of the licensed premises. This is particularly relevant in
relation to matters of banned individuals.
16. The premises licence holder shall ensure the disposal of waste from the frontage
of the licensed premises and make provision for the timely emptying of litter bins in
the vicinity of the premises.
17. Adequate lighting shall be provided to external areas of the licensed premises
(and in any car park) during the hours of darkness, when any licensable activity
takes place on the premises. Such lighting should not be positioned or of such
specification so as to cause a public nuisance to neighbouring properties via light
pollution. Temporary lighting facilities such as lanterns or torches may be used
where the time of year and volume/movement of traffic renders this method
suitable. Trained stewards shall be made available to assist with parking and
vehicle movements.
18. The premises licence holder shall conduct and document site risk assessments
and training of staff, both of which shall address promotion of the licensing
objectives and detail any specific site characteristics which may assist with the
prevent crime and disorder.
Public safety
19. A valid policy of public liability insurance shall be maintained by the premises
licence holder commensurate with the nature and scale of licensable public
activities at the licensed premises. A copy of the policy schedule shall be made
available to an authorised officer of a responsible authority upon request
20. Access and egress routes, including for emergency vehicles, at the licensed
premises shall be clearly identified and kept clear or any obstruction or hazard.
21. Exit routes and doors shall be regularly checked, including as part of the site risk
assessments.
22. All fire doors shall be fitted with self-closing devices and shall not be held open
other than by approved devices (for example, electromagnetic releases operated
by smoke detectors).
23. I will make sure that escape routes and exits, including external exits, are
maintained to ensure that they are not obstructed, in good order with non-slippery
and even surfaces, free of trip hazards and clearly identified.
24. Public safety checks shall be carried out, and determined as satisfactory, prior to
the admission of the public or club members and guests. Details of such checks
shall be legibly recorded and maintained in a log-book.
25. The premises licence holder shall ensure that notices detailing the actions to be
taken in the event of fire or other emergency, including how the fire service should
be summoned, are prominently displayed at the licensed premises and protected
from damage and deterioration. Suitable and sufficient procedures shall be in
place to ensure that when disabled people are present, adequate arrangements
exist to enable their safe evacuation. Patrons shall be made aware of these
arrangements.
26. The premises licence holder shall ensure that an adequate and appropriate supply
of first aid equipment and materials shall be available on the premises. If more
than one first aider is present, the premises licence holder shall make sure that
their respective duties are clearly defined.
27. In the absence of adequate daylight, lighting in any area accessible to the public
shall be fully operational. Any emergency lighting batteries shall be fully charged
before the admission of the public.
28. All temporary electrical installations or equipment shall be inspected and PAT
tested prior to first use.
29. The premises licence holder shall ensure that the use of special effects or
mechanical installation is arranged and stored so as to minimise any risk to the
safety of the audience, performers and staff. Prior notification to the Licensing
and/or Fire Authority shall be given where there is any intended use of the
following special effects:
• Dry ice machines and cryogenic fog;
• Smoke machines and fog generators;
• Foam cannon/snow machine;
• Pyrotechnics, including fireworks;
• Real flame;
• Firearms;
• Motor vehicles;
• Strobe lighting;
• Explosives and highly flammable substances; and
• Lasers; (see HSE Guide The Radiation Safety of lasers for
display purposes [HS(G)95] and BS EN 60825; Safety of
laser products)
30. Contact details of local licensed taxi and private hire operators shall be made
available to attendees at the licensed premises.
31. Sufficient seating to accommodate 50% of the maximum capacity of the licensed
premises shall be made available at the licensed premises.
32. The premises licence holder shall ensure that stewards/attendants are not
engaged in any duties that would hinder the prompt discharge of their duties in the
event of an emergency or entail their absence from the premises site whilst they
are on duty.
33. Stewards and attendants shall be readily identifiable to the audience, whether by
high visibility apparel, uniform or other practical means.
34. The premises licence holder shall retain a copy of any certificate relating to the
design, construction and loading of any temporary seating available so that it can
be shown to any authorised person upon request.
35. No flammable films (nitrate or similar) shall be used, stored or permitted on the
licensed premises without prior notification to the Fire Service and/or Licensing
Authority.
36. During any film showing, the level of lighting in the screening area shall be as
great as possible, consistent with the effective presentation of the film.
37. The premises licence holder shall not use, or authorise the use of, any paraffin or
other mineral oil in any lamp, stove or other appliance except for cooking
purposes.
38. Any emergency use of portable heaters, electrical and propane, which may be
required if a breakdown of the main under floor heating system occurs or in
exceptionally cold weather conditions, shall be checked/tested by a competent
person prior to first use. Prior advice should be sought from the Fire Service on
safe storage and use of propane.
The prevention of public nuisance
39. The premises licence holder shall give prior notification to immediate residents of
licensable events at the premises. This condition may be satisfied by a
programme/list of events displayed immediately outside the premises.
40. The premises licence holder shall ensure that noise and vibration from licensable
activities at the premises are not noticeable (beyond the parameters of set limits
as agreed with local Environmental Health Officers) at the façade of the nearest
noise affected properties.
41. Doors and windows shall be kept closed (except for ingress and egress) during
licensable activities to reduce noise breakout or nuisance from the premises.
42. The premises licence holder shall install and operate a noise limiter on
amplification equipment in accordance with any guidance from the Council’s
Environmental Health Officers.
43. Prominent, clear and legible notices shall be displayed at all exits requesting
patrons to respect the needs of local residents and to leave the premises and the
area quietly.
44. There shall be no use of explosives, pyrotechnics, fireworks or effects/devices of a
similar nature during licensable activities, so as to minimise and disturbance in
surrounding areas.
45. The placing of bottles into receptacles outside the premises shall take place at
times that will minimise disturbance to nearby properties.
46. During the final hour that the premises are open for licensable activities and
events, the music volume levels shall be discernibly quieter.
47. The premises licence holder shall ensure that any request by an authorised officer
of the Licensing Authority in relation to reducing noise levels is complied with.
48. Any ventilation system at the licensed premises shall have suitable sound
attenuation.
49. Offensive or noxious odour from activities at the licensed premises shall not be
permitted so as to cause a nuisance to nearby properties, and the premises shall
be properly vented.
50. The premises licence holder shall ensure that receptacles for waste are emptied
and cleaned regularly to minimise nuisance smells. Adequate provision of lidded
waste receptacles shall be provided.
51. The premises licence holder shall ensure that flashing or particularly bright lights
on or outside the licensed premises shall not cause a nuisance to nearby
properties, whilst balancing the need for lighting in the interests of prevention of
crime and disorder.
52. The premises licence holder shall ensure that litter is regularly cleared from the
immediate vicinity of the premises. Within 24 hours of the finish of an outdoor
licensable event all refuse (including litter picking across the site) and off-site litter,
within one mile of the site along access and egress route, shall be cleared.
The protection of children from harm
53. Licensable events and activities at the premises shall be risk assessed according
to attendee age suitability, with any resulting age restrictions or recommendations
clearly publicised.
54. A crime prevention policy as approved by the Police and Local Authority shall be
in place at the licensed premises.
55. Where the Licensing Authority has chosen to make a recommendation on the
restriction of admission of children to a film, the premises licence holder shall
ensure that notices are displayed both inside and outside the premises so that
persons are aware of the age restriction.
56. Children shall be excluded or accompanied by an adult where the risk assessment
of the particular licensed activity or use determines a restriction is appropriate - for
example during any adult entertainment, film showing or activities involving the
supply of alcohol.
57. For children’s events there shall be a minimum of one attendant per fifty children
(or part thereof). The attendant shall be on duty in the area occupied by the
children and stationed on any exit point.
58. For performances put on by children, backstage facilities shall be arranged so as
large enough to safely accommodate the number of children taking part. The
premises licence holder shall ensure that all chaperones and production crew on
the show receive instruction on the fire and emergency evacuation procedures
prior to the arrival of any children.
59. In any performances involving children no special effects such as smoke machine,
dry-ice, rapid pulsating or flashing lights shall be used.
60. The premises licence holder shall ensure that children performing in productions
are kept under adult supervision at all times including transfer from stage to
dressing room and anywhere else on the premises. Suitable and sufficient
arrangements shall be in place to ensure that children are accounted for at all
times in case of any emergency or evacuation.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
61. A thirty-minute period for “drinking up time” is provided to allow customers to use the
facilities and disperse from the premises.
62. Free drinking water will be available at all times the premises is open to customers.
63. The supply of alcohol will be limited to attendees of events at the premises only.
64. The applicant will ensure that the receptacles for refuse storage are maintained in a
clean condition.
65. The applicant will ensure that litter is regularly cleared from the vicinity of the
premises.
66. The applicant will ensure that receptacles for waste are emptied regularly.
67. The applicant will provide adequate and suitable receptacles to receive and store
refuse from the premises.
68. The applicant will ensure that an adequate and appropriate supply of first aid
equipment and materials will be available at the premises.
69. A suitable pest control policy and procedure will be maintained at all times.
70. The level of noise emitted from the site shall not exceed the following, measured at
any point on the boundary adjacent to a noise sensitive property (i.e. a dwelling
house): -
33dB LAeq 1 hour between the hours of 7.00am and 11.00pm and 33dB LAeq 5
minutes between the hours of 11.00pm and 7.00am.
71. Doors and windows will be closed during the performance of any of the licensable
activities as set out in Parts A, B, E, F, G, H, I, J, K, L and M above except for access
to and egress from the premises.
72. Notices will be displayed requesting patrons to be quiet when leaving the premises, to
respect the neighbours and to leave the premises quietly and quickly.
73. All external doors save for the main front doors to be fitted with door closers, which
shall be properly maintained.
74. The car park at the premises to be maintained in good and proper order.
75. That signage be displayed encouraging the proper use and occupation of the said car
park.
76. The sitting of any marquees to be limited to the garden at the rear of the Great Barn.
77. No plays, films, live music, recorded music, performances of dance or anything of a
similar description are permitted to take place in any marquee or outdoors.
78. No amplified sound is permitted in any marquee or outdoors.
79. No discos will be permitted.
80. A challenge 21 policy will be implemented where anyone who appears to be under the
age of 21 years will be asked to provide identification to prove their age. The only
acceptable identification will be a photo driving licence, passport or PASS accredited
identification. Staff will be trained in this policy and proper records will be kept.
Further conditions added 14/03/2024
1. All staff shall be trained in the prevention of sales of alcohol to underage or drunken persons and a record of such training shall be retained at the premises and made available to the Police and an authorised officer of the Licensing Authority on demand. Refresher training shall be undertaken every 12 months.
2. A refusals book shall be operated and maintained on the licensed premises to record all instances of refused sales of alcohol and which shall be made available to the Police and an authorised officer of the Licensing Authority on demand.
3. Sales of alcohol shall not to include any super strength lagers, beers or ciders where the strength exceeds 6.5% ABV (alcohol by volume), for the avoidance of doubt this shall not exclude the sale of ‘specialist’ branded alcoholic beverages.
4. The premises licence holder shall ensure that a robust hiring process and agreement is in place for third party hiring requests to hire the licensed premises for licensable activities.
5. No illegal drugs shall be permitted on the premises, and all customers, hirers and users made aware of a zero tolerance to drugs on the premises.
6. An incident book shall be operated and maintained on the licensed premises to record all instances of crime and disorder related incidents and which shall be made available to the Police and an authorised officer of the Licensing Authority on demand.
7. All appliances and emergency lights shall be checked and serviced regularly and all portable electrical equipment shall be inspected and PAT tested annually.
8. The premise licence holder or a nominated representative shall be available during opening hours to receive and respond to any nuisance related complaints.
9. The premises licence holder shall ensure that adequate numbers of staff are on duty whilst the premises are open for licensable activities.
10. All internal areas and external areas shall be monitored by staff on duty whilst the premises are being used for licensable activities.
11. The premises licence holder shall ensure that adequate provision is made for the collection and disposal of waste and litter at the licensed premises.
12. The premises licence holder shall adopt a ‘Challenge 25’ proof of age scheme. The premises licence holder shall operate a requirement for the production of a passport, UK photocard driving licence or PASS accredited photocard, where the individual requesting the supply of alcohol appears to be under the age of 25.
13. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
