ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
Annex 2 - Conditions consistent with the operating schedule
The following conditions in Annex 2 are conditions consistent with the operating schedule
submitted by the licence holder within the application:
Prevention of crime and disorder
2.1 The premises licence holder shall install and maintain a recordable CCTV system
covering all entry and exit points at the licensed premises. Images shall be recorded
from the CCTV system on all occasions whilst the premises are open for licensed
activity and recordings shall be retained for a minimum period of 21 (twenty-one)
days. Recordings in a viewable format shall be provided to an authorised officer of
the Police or Local Authority upon request.
2.2 Signage shall be displayed and maintained prominently on the licensed premises
alerting persons on the premises that CCTV is in operation.
2.3 An incident log (whether kept in written or electronic format) shall be maintained,
retained at the licensed premises and made available to an authorised officer of the
Police or Local Authority upon request.
2.4 The licensed premises shall be installed with a panic button system and burglar
alarm system to promote the prevention of crime and disorder licensing objective.
Prevention of public nuisance
2.5 The premises licence holder shall take all reasonable steps to minimise public
nuisance arising from licensable activity at the premises, and in doing so shall have
due regard to any advice given by the responsible authorities (particularly the local
environmental health officer). An adequate complaints handling procedure shall be
implemented at the store to facilitate a system for local residents to report any
nuisance related complaints.
Protection of children from harm
2.6 A ‘Challenge 25’ (or equivalent) proof of age scheme shall be operated at the
licensed premises, to ensure that persons appearing to be under the age of 25 years
shall be asked to produce a valid form of photographic identity - such as passport,
driving licence or PASS accredited proof of age card - when attempting to purchase
alcohol.
2.7 An electronic cash register prompt system shall be operated at the licensed premises
to support the premises licence holder’s proof of age policy.
2.8 All staff at the licensed premises shall be suitably and sufficiently trained in relation to
the prevention of underage sales and proof of age scheme in operation at the store.
No member of staff shall be permitted to sell age restricted products without having
first successfully completed such training.
2.9 A refusals register (whether kept in written or electronic format) shall be operated and
maintained at the licensed premises, which shall legibly record all instances of where
the sale of alcohol is challenged or refused. The refusals register shall be made
available to an authorised officer of the Police or Local Authority upon request.
