Annex 1 - Mandatory conditions
General condition:
(1) No supply of alcohol may be made under the premises licence:
(a) at a time when there is no designated premises supervisor in respect of the
premises licence; or
(b) at a time when the designated premises supervisor does not hold a personal
licence or his personal licence is suspended.
(2) Every supply of alcohol under the premises licence must be made or authorised by a
person who holds a personal licence.
General condition:
In force from 1 October 2010
(1) The Premises Licence Holder or Club Premises Certificate Holder shall ensure that
an age policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be
under 18 years of age (or such older age as specified in the policy) produce on request,
before being served alcohol, identification bearing their photograph, date of birth and a
holographic mark.
Annex 2 - Conditions consistent with the operating schedule
The Prevention of crime and disorder
All alcohol to be displayed and sold at the premise to be kept behind the counter and to be
dispensed by a member of staff only.
The sale of alcohol shall be ancillary to the operation of the premises as a takeaway
restaurant. Alcohol to be supplied with a food order only.
No alcohol is to be sold/served or supplied whist the customer is waiting for a meal to be
prepared. Alcohol must not be consumed on the premises.
The delivery of alcohol to be made only to a residential or business address and the
customer to be clearly resident inside the building.
The delivery of alcohol will not be delivered to a person in a public place (street corner, park,
bus stop etc.)
All persons delivering orders will receive full advance training in selling alcohol, approved
forms of ID, challenge 25 policy and dealing with conflict.
Public Safety
Regular review of general fire precautions to comply with current legislation.
Applicant to carry out regular fire risk assessments to identify any risks and precautions to
be taken in compliance with current legislation.
The prevention of public nuisance
The applicant shall conduct regular assessments on noise levels outside the premise.
Staff shall implement a litter clearing policy outside the premises as within the definition of
“immediately outside”
The Protection of children from harm
All customers attempting to purchase alcohol who appear to be under the age of 25 shall be
required to produce a valid form of identification. Acceptable forms of identification are proof
of age card bearing the PASS hologram logo, an EU photo care, full driving licence or a
passport.
A refusals book shall be kept at the premises in which must record the date, time, and
circumstances under which any attempted purchase by a young customer has been refused.
This book is to be made available on request to any of the responsible authorities.
All serving and delivery staff shall receive regular training a minimum of 2 times a year on
the prevention of underage sales including challenge 25. Such training shall be kept in a
training record book and made available on request to any of the responsible authorities.
Delivery staff will also be reminded of the risks associated with delivery.
The delivery of alcohol will only be made by staff over the age of 18.
