Annex 1 - Mandatory conditions
General condition:
(1) No supply of alcohol may be made under the premises licence:
(a) at a time when there is no designated premises supervisor in respect of the
premises licence; or
(b) at a time when the designated premises supervisor does not hold a personal
licence or his personal licence is suspended.
(2) Every supply of alcohol under the premises licence must be made or authorised by a
person who holds a personal licence.
General condition:
In force from 1 October 2010
(1) The Premises Licence Holder or Club Premises Certificate Holder shall ensure that
an age policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be
under 18 years of age (or such older age as specified in the policy) produce on request,
before being served alcohol, identification bearing their photograph, date of birth and a
holographic mark.
Annex 2 - Conditions consistent with the operating schedule
All alcohol shall be stored/displayed behind the counter in order to promote the prevention of crime and disorder.
The Premise Licence holder shall ensure sale of alcohol is ancillary to the operation of the premises as a takeaway restaurant. For the avoidance of doubt the sale of Alcohol shall only be made with food orders and not whilst patrons are waiting for their food to be prepared.
The delivery of alcohol shall be made only to a residential or business address and the customer shall be clearly resident inside the building.
The delivery of alcohol shall not be delivered to a person in a public place (street corner, park, bus stop etc.)
The Premise Licence holder shall ensure that all delivery staff of alcohol are over the age of 18
The Premise Licence holder shall ensure all delivery staff are made aware of the risk associated with delivery.
The premises and public areas immediately outside shall be kept free from waste or litter associated with the operation of the business
The premises licence holder shall conduct a suitable and sufficient fire risk assessments to identify any risks and precautions to be taken.
The premise licence holder shall ensure regular assessments on noise levels outside the premise are carried out.
The premise licence holder shall adopt a ‘Challenge 25’ proof of age scheme. The premises licence holder shall operate a requirement for the production of a passport, UK photocard driving licence or PASS accredited photocard, where the individual requesting the supply of alcohol appears to be under the age of 25.
A refusals book shall be operated and maintained on the licensed premises to record all instances of refused sales of alcohol and which shall be made available to the Police and an authorised officer of the Licensing Authority on demand.
All staff shall be trained regularly (minimum twice a year) in the prevention of sales of alcohol to underage or drunken persons and a record of such training shall be retained at the premises and made available to the Police and an authorised officer of the Licensing Authority on demand.
