ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
Annex 2
General
The premises licence holder shall create and implement comprehensive and appropriate written policies to cover all aspect of its trading operations including those pertaining to the sale of alcoholic products. All staff must be trained in all aspects of these policies; the training of staff shall be reviewed six-monthly to ensure that all staff are up to date with the latest legislation and policies.
The premises licence holder shall ensure that the store manager is trained to Level 2 Award for Personal Licence Holders or its equivalent, within three months of commencing employment at the premises. Training records shall be kept on the premises and produced to the Police and/or authorised officer of the Licensing Authority upon request. For the avoidance of doubt this training may be administered in-house in accordance with the relevant criteria. Training shall be reviewed six-monthly to ensure that staff are up to date with the latest legislation.
The prevention of crime and disorder
An incident book(s)/ refusals register shall be kept and maintained on the premises at all times. The book(s) shall detail all incidents but not limited to age challenge. Such matters shall be timed, dated and signed by the author and produced to Police/authorised Licensing Officer on request. In case of refusals register, there shall be one at each till. The following alcohol shall NOT be sold from the licensed premises:
(a) Beer (including lager) or cider with an alcoholic strength by volume of 6.5%
The protection of children from harm
The premises licence holder shall ensure that an age verification policy will apply to the licensed premises whereby all cashiers shall be trained to ask any customer attempting to purchase alcohol, who appears to be under the age of 25 years (or older if the premises licence so elects) to produce, before being sold alcohol, identification being a passport or photo card driving licence bearing a holographic mark or other form of identification bearing the customer's photograph, date of birth and Proof of Age Standards Scheme (or similarly accredited scheme) hologram.
The premises licence holder and the designated premises supervisor shall ensure that the signage on the 'Challenge 25' (or equivalent) proof of age scheme is to be prominently displayed and maintained in the till area.
The premises licence holder and designated premises supervisor shall operate a suitable prompt system to require cashier to verify the age of the purchaser for any age restricted products.
All staff shall be fully trained in the age verification policy and the prevention of underage sales policy. Training shall be reviewed six-monthly to ensure that staff are kept up to date. These policies must be kept under regular review and that all staff are retrained immediately and changes to these policies occur. Training records shall be kept on the premises and produced to the Police and/or authorised officer of the Licensing Authority upon request.
