Annex 2 - Conditions consistent with the operating schedule
General
The business is to be run to provide take away refreshment with the intention of developing
a regular clientele in a safe, friendly and neighbourly manner.
The Prevention of Crime and Disorder
CCTV camera/recording provided to monitor customer area.
Persons who are abusive or showing adverse effects of alcohol or drugs will not be served.
No alcohol or drugs will be permitted on the premises.
Staff are trained to deal with any disturbances which may occur.
Cash will be kept in a secure till and removed at regular intervals.
Public Safety
The premises are well lit and maintained.
Fire safety equipment is regularly serviced as detailed by the Manufacturers and Service
Company.
Any problems/spillages which occur will be dealt with as a matter of urgency to maintain a
safe environment.
The premises are accessible to all ages and disabilities.
The Prevention of Public Nuisance
Litterbins will be provided for rubbish.
Customers will be asked to wait in the designated waiting area whilst orders are prepared.
Customers will be requested to keep noise to a minimum where appropriate.
The Protection of Children from Harm
There would be no restrictions in serving children during the day/early evening.
Caution will be exercised in serving persons who are clearly under the age of 15 years after
23.00.
Annex 3 - Conditions attached after a hearing by the licensing authority
1. The applicant is to install at least two signs within the premises near the entry and exit
points asking patrons to leave quietly and respect local residents.
2. The applicant is to provide at least two litter bins (of the size equivalent to the black litter
bins in the High Street where the premises are situated) outside of the premises for use by
patrons and the applicant is to take in these litter bins at the close of business.
3. The applicant is to keep a written record of litter patrols completed in the form of a chart
recording the time, date and the person who completed the litter patrol. The applicant is
required to produce the record of litter patrols to the Licensing Authority or the Police on
demand.
These conditions are attached by the Licensing Panel on 15th December 2011 in
respect of the decision to determine the application to vary the premises licence:
1. The Premises Licence holder will provide CCTV which will be in the form of a
recordable system, capable of providing pictures of evidential quality in all lighting
conditions.
2. The Premises Licence holder shall maintain CCTV in the premises covering both
inside and outside the premises.
3. The Premises Licence holder must maintain the CCTV equipment in good working
order, be correctly time and date stamped, recordings must be kept in date order,
numbered sequentially, kept for a period of 28 days and handed to the Police or
Licensing Authority upon request.
4. The Premises Licence holder shall display Signs to inform people that CCTV is in
operation.
5. The Premises Licence holder must ensure that at all times an appointed member of
staff, present on the premises, is capable and competent at downloading CCTV
footage in a recordable format EITHER CD/DVD DISC or VHS for the
Police/Licensing Authority upon request.
6. In the event of technical failure of the CCTV equipment the premises licence holder
MUST report the failure to the Police on the 101 contact number immediately.
7. The Premises Licence holder is to place an identifying mark or wording on all
packaging used in the provision of late night refreshment to indicate the name and
address of the premises.
8. The Premises Licence holder shall ensure that litter is cleared from the frontage of the
premises every night (provided that the business is open for trading on that night)
including litter in the vicinity of the premises that obviously emanates from the
Premises Licence holder’s business.
9. The Premises Licence holder shall implement a litter patrol for 30 minutes each night
after closing to ensure all waste is collected from the premises frontage and area
adjacent to the premises whether the waste arises from the premises or not.
10. The Premises Licence holder is required to keep a written record of litter patrols
completed in the form of a chart recording the time, date and person who completed
the litter patrol. The Premises Licence holder is required to produce the record of litter
patrols to the Licensing Authority or the Police on demand.
Annex 4 - Conditions, terms and restrictions to be removed
These conditions are removed by the Licensing Panel on 15th December 2011 in respect of
the decision to determine the application to vary the premises licence
3. The applicant is to place an identifying mark or wording on all packaging used in the
provision of late night refreshment to indicate the name and address of the applicant.
4. The applicant is to clear litter from the frontage of the premises every night (provided that
the business is open for trading on that night) including litter in the vicinity of the premises
that obviously emanates from the applicant's business.
5. The applicant is to arrange for its staff to engage in a litter patrol on a Friday and
Saturday night. The litter patrol is to clear all litter from the front of the premises to width
equivalent to the width of the premises and width of the premises either side of the
applicant's premises and out as far as the roadway.
After hearing representations from the applicant the panel conditionally agreed to remove
from this Premises Licence the Condition: “The applicant is to provide at least two litter bins
(of the size equivalent to the black litter bins in the High Street where the premises are
situated) outside of the premises for use by patrons and the applicant is to take in these
litter bins at the close of business”. The Panel considered that this was no longer necessary
to promote the Licensing Objectives, however the Panel when making this decision did so
with the proviso that the Premises Licence holder replaces these with the equivalent
permanently fixed litter bins. Only then will this condition be implemented.
