ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
4. Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority.
5. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
6. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
7. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
8. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
9. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
Annex 2- Conditions consistent with the operating schedule
General
All bar staff engaged in the sale of alcohol to be trained in responsible alcohol retailing to the minimum standard of BIIAB level 1 or equivalent, within three months of commencing employment at the premises. Training records shall be kept on the premises and produced to the Police and/or authorised officer of the Licensing Authority upon request. For the avoidance of doubt this training may be administered in-house in accordance with the relevant criteria. Training shall be reviewed six-monthly to ensure that staff are up to date with the latest legislation. All current staff shall be trained to the above standard within six months.
The premises licence holder shall put into place practices and promotions to encourage drivers to drink soft drinks only. Non-alcoholic beverages including soft drinks, drinking water, coffee and tea shall be available at all times whilst the sale by retail of alcohol takes place at the premises.
The premises licence holder and designated premises supervisor shall subscribe to the local Pubwatch scheme.
The prevention of crime and disorder
The premises licence holder shall ensure that the installed CCTV system is in use 24 hours a day including recordings.
The premises licence holder shall implement the ‘Challenge 25’ scheme, ensuring prominent signage is displayed throughout the premises and that all staff are fully trained in its operation.
The premises licence holder shall implement a serving policy, relating to drunkenness abusive or unsusceptible behaviour. Customers who appear to have consumed too much alcohol will not be served any more alcohol; this also includes displaying inappropriate behaviour will be ejected from the premises. All staff will be trained and supported in this area.
The premises licence holder and designated premises supervisor shall take a zero tolerance on antisocial behaviour, violence and discrimination. Anyone behaving in an unacceptable manner will be asked to behave appropriately or ejected from the premises.
Public safety
The premises licence holder shall ensure that first aid training for those assigned to be first aiders, is kept up to date and that a first aid box is made available on premises.
The premises licence holder shall ensure that Drink and Drug awareness information is displayed on the premises.
The prevention of public nuisance
The premises licence holder shall adopt and implement a good neighbour policy.
The protection of children from harm
From 20:00 hours No person under the age of 18 shall be permitted on the licensed premises.
At all times under 18's must be accompanied by an adult and appropriately supervised whilst on the licensed premises.
Where the premises licence holder views any issues relating to the abuse of children or vulnerable adults these must be reported to the Police and/or Social Services.
Annex 3- Conditions attached after a hearing by the licensing authority
1. The Premises Licence holder will ensure that all windows and doors are kept closed during indoor events which involve the use of music ( whether amplified or acoustic) except for ingress and egress from the premises. Save that during the months of May to September either the door or windows maybe open until 22:00 hours;
2. The Premises Licence holder will ensure that there is no consumption of alcohol is in the outdoor area as defined in the plan attached to the premises licence beyond 22:00 hours;
3. The Premises Licence holder will ensure that any external lighting is angled downwards to the ground to maximize the light where people need to be able to see, and to minimize the risk of light pollution to nearby residents;
4. The Premises Licence holder will ensure that notices are displayed requiring patrons to leave the area quietly and that anyone using the outdoor area is to be respectful towards neighbours and nearby properties;
5. The Premises Licence holder or their representative on the premises will ensure that the volume control of recorded music or any amplification equipment is under their direct control;
6. The Premises Licence holder or their representative on the premises will comply with the direct request by an authorised officer of the Council or the Police for the volume to be turned down on any recorded music or amplification equipment;
7. The Premises Licence holder shall install a CCTV recordable system that is capable of providing pictures of evidential quality in all lighting conditions and this must include facial recognition;
8. CCTV cameras must be set to record all ingress and egress to the premises, fire exits, the outdoor area of the premises and all other areas where the sale and supply of alcohol occurs;
9. The Premises Licence holder will ensure that the CCTV equipment is maintained in good working order and is correctly time and date stamped;
10. The Premises Licence holder will ensure that all recording by the CCTV equipment is kept in date order, numbered sequentially, kept for a period as specified within their retention policy in accordance with the CCTV code of practice, however those recording must be retained for longer periods where a law enforcement body is investigating a crime; It should be noted that any retention, use or disclosure of personal information caught on CCTV must be carried out in line with data protection principles which shall override any conflicting element of this condition.
11. The Premises Licence holder or designated premises supervisor shall in the event of a technical failure of the CCTV equipment, report the failure immediately to the Police and Licensing Authority;
12. The Premises Licence holder or designated premises supervisor will ensure that they use either the Town Link Radio, the 999 service or non-emergency number to immediately (or as soon as reasonably practicable thereafter) notify the Police of all instances of (i) drunken or disorderly behaviour, drug use or violence, and (ii) individual(s) who have been ejected from the premises; The Premises Licence holder shall ensure that an incident book is maintained and kept on the premises at all times. The incident book shall contain but is not limited to incidents of injury, ejection, refusals, drug misuse, and challenges of age. The recorded incidents in the book shall include the date and time of the incident and shall be signed by an appointed staff member(s). The incident book shall be produced to the Police and authorised officer of the Licensing Authority upon request;
13. Where an incident that has occurred involving violence, the premises management and/or staff members will take all reasonably practical steps to identify the offender and pass on the identity to the Police as soon as it is reasonably practical to do so. In the event of these occurrences an entry in the incident book must be made.
