Annex 1- Mandatory Conditions
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor (DPS) in respect of the premises licence, or
(b) At any time when the designated premises supervisor (DPS) does not hold a personal licence or his/her personal licence is suspended.
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
4. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
5. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
6. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
7. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
8. The relevant person (the holder of the premises licence, the designated premises supervisor (if any) in respect of such a licence, the personal licence holder who makes or authorises a supply of alcohol under such a licence, or any member or officer of a club present on the premises in a capacity which enables the member or officer to prevent the supply in question) shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
For the purposes of this condition “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979, “permitted price” is the price found by applying the formula -
P = D + (D x V)
where - (i) P is the permitted price, (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii)
V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
[“value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994]
Annex 2 - Conditions consistent with the operating schedule
General
Journey Through The Ages Vintage Rally & Country Fair will be marketed through the local media and is being advertised as a 'family event'. Due to the location of Goodrich Park, noise and light should not create any issues however we shall still be mindful of this and both will be kept to a minimum.
The Licensee will produce a Health & Safety report for all potential hazards and monitor compliance throughout the weekend.
The Licensee will also ensure:
* Public Liability Insurance is in place
* Security staff and Stewards/ volunteers are present each day to keep public order and monitor crowd safety.
* The Police and Fire Service are notified of the event and ensure first aiders are available on site during opening hours.
The prevention of crime and disorder
Due to its location and the way the event will be marketed, it will mostly be families attending. As the park is not very accessible from nearby towns and not serviced by public transport, most visitors will be arriving by car. The organisers will be on site from Friday 19th June 2015 - Sunday 21st June 2015.
The Licensee will:
Ensure that the Police are notified.
* Ensure that excessive ordering of alcohol is not allowed when last order have been called.
* Not adopt any drink promotion activities that undermine a policy of responsible drinking.
* Ensure that at all times when the premise is open for any licensable activity there are sufficient, competent staff on duty.
* Ensure that non-alcoholic drinks are available at all times on the premises.
* Use security (door supervisors) licensed by the SIA and employed from a reputable company.
Security will ensure that they:
* Manage the entry point on to the premises and exclude customers who appear to be drunk or disorderly.
*Maintain good order both inside and outside the premises and eject customers who appear drunk or disorderly.
* Assist police if they are called on to the premises.
*Report all instances of crime and disorder to Suffolk Constabulary and ensure that a record of the incident is entered in a log book which must be kept on the premises during licensable activities.
* Adopt a proof of age scheme (Challenge 21)
* Provide the Police with contact details for premises staff.
Public safety
Public safety is of high priority.
The beer tent will be erected and constructed to follow Muta Guidelines and will have emergency lighting and exit signs in place.
No smoking signs will be fixed to any temporary structure.
Re-enactments groups will only perform behind safety fences.
First Aid will be available all weekend and fire points located around the showground.
The Licensee will:
*Produce a Health & Safety report and perform risk assessments throughout the day.
*Ensure that all traders and exhibitors provide proof of any official licence, insurance and comply with risk assessments on the day. (Each trader and exhibitor must also provide a copy of a risk assessment).
*Ensure that all Cabling or trip hazards are made safe and that all erections are secure and any hazard fenced off.
*Ensure that First Aid is on site during opening hours.
The Licensee will comply with the following:
*An EMP will be produced along with a TMP for this event along with risk assessments. The EMP will also include details on a Major Incident Plan and show stop procedure.
*The site shall be laid out in accordance with a site plan and a copy of the plan shall be made available by the License Holder for inspection by the Responsible Authority for Public Safety upon request.
*The Licensee shall have regard to the publication The Event Safety Guide -A Guide to Health, Safety and Welfare at Music and Similar Events (ISBN 0-7176-2453-6), or any subsequent revision thereof, when determining safety arrangements for the event.
*The Licensee shall provide a sufficient number of appropriately trained and/or suitably instructed stewards to ensure public safety on the Licensed Premises.
*The Licensee shall ensure that Medical and First Aid Provision shall be determined by an assessment of activities and arrangements in place at the event and provided accordingly.
*All temporary electrical installations on the site shall be checked by a competent person to ensure they have been installed safely.
*All electrical equipment shall be installed, so far as is reasonably practicable, to prevent interference with it by unauthorised persons.
*The Licensee shall ensure that any temporary structure is erected in accordance with the approved plans and is safe for the intended use.
*The Licensee shall take all reasonable steps to minimise the presence of glass containers on the Licensed Premises.
*A list of all food businesses involved in the preparation, handling and/or sale of food on the Licensed Premises shall be made available by the License Holder for inspection by the Responsible Authority for Public Safety. Appropriate Licenses must be display by food vendors.
*The Licensee shall ensure, so far as is reasonably practicable, that all vendors on the Licensed Premises carry on their own activities without compromising public safety.
*The Licensee shall provide sufficient toilet facilities for persons on the Licensed Premises and shall maintain those facilities in a hygienic condition. Toilet facilities shall be sited in suitable locations.
*The Licensee shall provide sufficient means for persons on the licensed premises to maintain adequate personal hygiene.
*Provide the Emergency Services with a contact telephone number for the Event Director.
*Provide provision for waste disposal and litter removal across the site for the duration of the weekend.
*Display signage for the duration of the event alerting attendees to the facilities, activities and general information.
The prevention of public nuisance
The organisers will be on site from 19th June 2015 and with the help of stewards and security, will monitor public behaviour throughout the weekend. Our Event Safety Manager will also be on site for the weekend and is trained for Spectator Safety (level 4).
The Licensee will:
*The Licensee will monitor the activities of the public at all times and (if appropriate) remind them of their public responsibilities.
*Inform Environmental Health of the event.
*The Volume of any amplification system for entertainment shall be strictly controlled so that noise levels do not cause a nuisance.
*Ensure that any use of the public address system shall be finished by 1800Hrs each day except for use in an emergency.
*At all times during the operating hours, the Premises Licence Holder or a nominated assistant shall be available to receive and respond to nuisance-related complaints. A contact telephone number shall be provided to the Licensing Authority for that purpose prior to the day of the event.
The protection of children from harm
We have a Lost Child (DEPENDENT) Policy in place should any child be handed over to us or found lost.
Strict guidelines are in place for this and the lady in charge of this point is CRB checked. Throughout the event, stewards will be mindful of lost children and will report any in appropriate events.
The Licensee will ensure that all stewards and security staff are briefed on the procedure for lost children and that an Event Control Point is available for public enquiries related to child safety.
The Licensee will adopt a proof of age scheme (Challenge 21).
There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
