ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
5. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
6. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
7. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
8. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
9. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE:
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
2.1 The premises for the event shall be the part of the village green in Stowupland adjacent to Thorney Green Road, as attached as Annex 4 to the premises licence and as shown in the layout plan attached to the Event Management Plan.
2.2 The nature and type of the event shall be family entertainment and music. The sales of alcohol shall be exclusively from a beer tent providing real ale, wine, cider and a range of soft drinks. All alcohol shall be provided for consumption within the confines of the site. Strict controls shall be in place regarding the sale of alcohol as detailed in the Event Management Plan and Risk Assessment documents.
2.3 SIA security staff and volunteer stewards shall be on site throughout the duration of the event. The premises licence holder shall liaise with the security provider regarding a security plan for the event and shall deploy security staff in such numbers, times and areas as found appropriate by the security plan risk assessment.
2.4 There will be separate refreshment outlets for the sale of non-alcoholic drinks although soft drinks will also be available from the beer tent.
2.5 The premises licence holder shall create and implement an Event Management Plan (EMP) to promote the licensing objectives for the licenable event. An up to date version of the EMP and up to date site plans shall be sent by the premises licence holder to the Licensing Authority and all Responsible Authorities no later than 14 (fourteen) days prior to the first day of the event. Any proposed revisions to the EMP shall be notified in writing with the relevant Responsible Authority before the master EMP is updated – which shall be as soon as reasonably practicable following the revision being notified. The premises licence, event management plan and risk assessments shall be kept with all other event documentation in the event control for the duration of the event and this location shall be clearly identified on the site plan.
2.6 The boundary of event arena shall be kept suitably and sufficiently secured, include use of 'Herras' type fencing where appropriate. The arena area shall be fenced so that children cannot stray from the arena or onto the public highway.
2.7 A minimum of four SIA security staff shall be on duty and on site between 11.30am and 5.30pm, and this shall increase to a minimum of eight SIA security staff being on duty and on site between 5.30pm and 11.30pm for the day of the event.
2.8 SIA staff shall be deployed at entry points and around the arena area to monitor and enforce the ‘no glass’ policy and ensure the exclusion of intoxicated persons from the licensed area. SIA staff shall also be tasked to conduct random searches on attendees at entry points and across the arena. Any prohibited or confisdcated items shall be securely stored for return or depositing to the Police where appropriate (for example illegal drugs or weapons).
2.9 All sales of alcohol shall cease and the bar area shall close by 10.30pm on the day of the event.
2.10 The event shall close promptly by 11.00pm and SIA staff shall then immediately conduct a sweep of the arena so that no persons are congregating.
2.11 All stewards and security shall receive a suitable and sufficient brief from the premises licence holder prior to the commencement of the licensed event.
2.12 First aid and medical provision shall be made for the event on site between midday and 11.00pm on the day of the event.
2.13 The main top-billed music attractions shall cease by 10.30pm with a calmer music performance to aid dispersal taking place between 10.30pm and closure of the event at 11.00pm.
2.14 The licence holder shall make provision for and promote a taxi pick-up area on the site to aid departure of attendees from the event.
2.15 The premises licence holder shall implement the ‘Challenge 25’ scheme, ensuring prominent signage is displayed throughout the premises and that all staff are trained in its operation.
2.16 The premises licence holder shall operate a robust lost children’s policy which shall be referred to in the Event Management Plan and event literature.
