ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
4. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
6. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
7. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
8. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
9. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE:
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. Regulated performances of a play shall not exceed 3 (three) occasions per calendar month.
2. Regulated film exhibitions shall not exceed 3 (three) occasions per calendar month.
3. Performances with a main element of regulated live music shall not exceed 3 (three) occasions per calendar month. This frequency condition shall not apply to live music forming part of an exhibition, workshop or similar activity.
4. Performances with a main element of regulated dance activity shall not exceed 3 (three) occasions per calendar month. This frequency condition shall not apply to dance forming part of an exhibition, workshop or similar activity.
5. The supply of alcohol for consumption on the premises during performances or other activities shall not exceed 8 (eight) occasions per calendar month.
6. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give concern in respect of children.
7. The premises licence holder shall ensure that full training on promotion of the licensing objectives shall be given to all staff and performers before their duties/performances commence at the licensed premises.
8. The premises licence holder shall ensure that a full safety briefing is delivered to all performers before performances commence at the licensed premises. A basic safety introduction shall also be delivered at the start of any class, workshop or activity.
9. The licensed premises entrance and exit shall be adequately illuminated during the hours of darkness and whilst the premises are being used for licensable activities, with all reasonable precautions taken to ensure that such lighting does not cause a nuisance to neighbouring properties.
10. The premises licence holder shall ensure that at least one suitably and sufficiently trained first aider, or any greater number from the premises licence holder’s risk assessment for medical provision, shall be on duty at the premises during, and for the duration of, licensable activities.
11. The premises licence holder shall ensure that suitable and sufficient risk and impact assessments are completed prior to all events involving licensable activities.
12. The licensed premises shall be maintained so as adequately secured and fitted with an alarm system.
13. The premises licence holder shall ensure that the premises management liaise regularly (at least once every six months) with the local Police and crime reduction officer to ensure the premises staff and management are aware of, and vigilant in respect of, any local crime and disorder issues which may affect activities at the licensed premises.
14. The premises licence holder shall ensure that SIA (Security Industry Authority) door staff are provided where any event/activity risk and impact assessment identifies a need. This may include activities for younger or larger audiences. For the avoidance of doubt this condition does not override the separately conditioned requirement for door supervision for all licensable events for 70 (seventy) or more persons.
15. Where door supervision is provided for an event or activity, the premises licence holder shall ensure that the door supervisor(s) is/are in direct communication, whether by means of a radio/walkie-talkie/mobile phone, with the ticketing or entrance supervisor and designated premises supervisor (DPS).
16. The premises licence holder shall ensure that a suitable and sufficient dispersal policy is in place for the managed departure of attendees and performers from the licensed premises following an event or activity involving licensable activities.
17. The premises licence holder shall ensure that no glassware or bottles are used for events or activities where the risk and impact assessment identifies it is appropriate to use plastic or polycarbonate alternative drinking vessels. This may include activities for younger or larger audiences.
18. The premises licence holder shall ensure that a suitable and sufficient emergency and evacuation plan is in place, and clearly communicated to staff, performers and attendees at the licensed premises.
19. The premises licence holder shall ensure that exits points are adequately monitored and managed, including at intervals, to ensure that attendees (including smokers observing the smoke free regulations) are not congregating or acting in a manner that may cause a public nuisance. Smokers and persons leaving the licensed premises shall be requested to keep noise levels at a minimum and to respect the needs of neighbours.
20. The premises licence holder shall ensure that adequate provision is made for the collection and disposal of waste and litter at the licensed premises and the immediate vicinity, including cigarette ends and other smoking litter.
21. There shall be no disposal of bottles or glassware in waste receptacles outside of the licensed premises between 23:15hrs and 07:30hrs on any occasion. Such waste shall be retained inside the premises for later disposal during those timings.
22. The premises licence holder shall ensure that staff on duty are vigilant and monitor the alcohol consumption levels and behaviour of attendees to licensable activities/events at the licensed premises.
23. All doors and windows shall be kept closed, save for access or egress, during any performances identified by the premises licence holder’s risk and impact assessment as carrying an elevated risk of disturbance to neighbouring properties.
24. Main performances of regulated entertainment activities shall be limited to the main banking hall and strong room areas of the licensed premises to minimise the impact of those activities on neighbouring properties.
25. The premises licence holder shall ensure that a suitable and sufficient child protection policy is in place for licensable activities at the licensed premises.
26. A ‘Challenge 25’ policy shall be operated by the premises licence holder at the licensed premises. Any person attempting to purchase alcohol who appears to be under the age of 25 years shall be required to provide a bona fide photographic identity document to verify their age. For this purpose a passport or national identity card, photo identity driving licence or PASS approved card with hologram shall be acceptable forms of identification.
27. For performances involving licensable activities and specifically aimed at children, there shall be a minimum ratio of 1 (one) adult staff member for every 50 (fifty) children present.
28. Any children present on the licensed premises during licensable activities shall be under the supervision of an adult, with not less than 1 (one) adult supervisor for every 10 (ten) children.
For classes/workshops where persons under the age of 18 are participating, there shall be a minimum staff/tutor attendance of not less than 1 (one) for every 10 (ten) children.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY:
1. There shall be no sale or supply of alcohol available for consumption off the licensed premises. For the avoidance of any doubt this condition shall apply to smokers and other persons leaving the premises, whether temporarily or permanently.
2. The authorised hours for the supply of alcohol shall be reduced from those within the original application to now commence at 12 noon Monday to Sunday (instead of 8am Monday-Saturday and 10am Sunday) and finish at 10pm Monday to Saturday and 3pm Sunday (instead of 11pm Monday-Saturday and 4pm Sunday).
3. For any event or activity involving licensable activities at the licensed premises, which are provided or accessible for 70 (seventy) or more persons at any one time, a minimum of one SIA (Security Industry Authority) registered door supervisor, shall be on duty for the duration of the event or activity. For the avoidance of any doubt, the capacity of 70 (seventy) or more persons for the purpose of this condition shall include staff and performers on the premises.
4. Notices shall be prominently displayed and maintained on the licensed premises requesting attendees to leave the premises and the vicinity quietly and with consideration to the needs of neighbouring properties.
