Annex 1 - Mandatory conditions

In force from 6 April 2010 (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises. (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children - (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to - (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or (ii) drink as much alcohol as possible (where within a time limit or otherwise); (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act); (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less; (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on - (i) the outcome of a race, competition or other event or process, or (ii) the likelihood of anything occurring or not occurring; (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or refer to the effects of drunkenness in any favourable manner. |

(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as specified in the policy) produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark. |

In force from 1 October 2010 The responsible person shall ensure that - (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures - (i) beer or cider: 1/2 pint; (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and (iii) still wine in a glass: 125 ml; and (b) customers are made aware of the availability of these measures. |

(1) The admission of children to the exhibition of any film is to be restricted in accordance with this section. (2) Where the film classification body is specified in the licence, unless subsection (3) (b) applies, admission of children must be restricted in accordance with any recommendation made by that body. (3) Where: (a) the film classification body is not specified in the licence, or (b) the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority. (4) In this section: "children" means persons aged under 18; and "film classification body" means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c. 39) (authority to determine suitability of video works for classification). |

(1) No supply of alcohol may be made under the premises licence: (a) at a time when there is no designated premises supervisor in respect of the premises licence; or (b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended. (2) Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence. |
Haughley Park - updated site licence controls (including frequency restrictions)
2.1 The number of outdoor events involving licensable activity or activities, under the authority of the premises licence, shall be limited in total to not more than 30 (thirty) event days per calendar annum. For the avoidance of doubt, an event held over any two-day duration would count as two events for these purposes. Setup and takedown days do not count as event days.
2.2 Sale of alcohol for consumption OFF the licensed premises shall be for daytime events such as farmer markets, country fairs, food and drink and similar events. Off sales for such occasions shall be limited to between the hours of 11:00hrs and 18:00hrs.
2.3 There shall be no late night refreshment for takeaway consumption beyond the perimeter of the licensed premises.
2.4 No outdoor event shall take place under the authority of the premises licence where there is an attendance of 5000 or more persons at any one time (including staff, performers, stallholders and contractors). An outdoor event may include the use of the indoor venue, Haughley Park Barn.
2.5 Up to a maximum of 15 (fifteen) outdoor events per calendar year may exceed an attendance of 500 persons. Larger outdoor events are likely to be 2-day events.
2.6 Up to a maximum of 15 (fifteen) outdoor events per calendar year may exceed an attendance of 250 persons. Smaller outdoor events are likely to be of 1 or 2 days duration.
2.7 No indoor event at Haughley Park Barn shall exceed an attendance of 250 persons.
2.8 An indoor event at Haughley Park Barn may include the use of the surrounding lawns for the consumption of alcohol but not for other licensed activities.
2.9 The number of indoor events involving licensable activities is not limited by the premises licence, and these will mainly be wedding events, meetings, lectures or corporate events.
2.10 The premises licence holder shall ensure that all event organisers/premises users prepare and operate suitable and sufficient Event Management Plans and Risk Assessments which are compatible with the premises licence holder’s own Site Risk Assessments and Terms and Conditions of Hire.
2.11 The premises licence holder’s BARN OPERATING PROCEDURE (Indoor Events and Indoor/Outdoor Events up to 500) shall include:
(a) Risk Assessments for Fire and Safety which shall be reviewed at least once per annually.
(b) All appliances shall be serviced at least annually. The following documents shall be made available to hirers and to the responsible authorities upon request:
(i) Gas Safe Certificate
(ii) PAT Test Record
(iii) Fire Equipment Inspection Certificate
(iv) Fire Alarm Service Report and Fire Alarm Testing Log
(v) Fire Exit Lighting
(vi) Kitchen and Duct Deep Clean Certificate
(vii) Pest Control Reports
(viii) Accident Log
2.12 The premises licence holder shall ensure that all non-regular hirers complete a Hirer’s Information Sheet and return an Event Details Sheet a minimum of 6 (six) weeks before the licensable event.
2.13 The premises licence holder shall ensure that all event organiser’s/premises users provide contact details of their service or activity providers and the name of the main event organiser/premises user. The premises licence holder shall ensure that event organisers/premises users are clearly advised of their responsibilities in relation to promotion of the licensing objectives and risk assessments. The premises licence holder shall notify the event organiser/premises user of all site particulars, including any prohibitions, and require sight of the event organiser/premises user’s risk assessment (including any special activity risk) documentation for all events involving licensable activities and prior to the commencement of the event.
2.14 The premises licence holder’s OUTDOOR EVENT OPERATING PROCEDURE (Events over 500 to a maximum of 5000) shall include:
(a) Providing all prospective event organisers with the premises licence holder’s a general Outdoor Site Risk Assessment for Larger Events.
(b) Requiring the event organiser to produce a specific EVENT MANAGEMENT PLAN for all events likely to exceed an attendance of 500. This shall cover the following aspects of the event, as a minimum:
Nature of event and range of licensable activities intended
A site plan delineating the contained area of licensable activities and of car parking
Event open timings and set up and build down programme
Expected attendance numbers
Traffic and parking control
Marshals, stewards, security or crew numbers
Child safety and protection measures
Temporary structures and equipment
Compliance with the Licensing Act 2003 and promotion of the four licensing objectives
Catering facilities and hygiene
Toilets and first aid facilities/medical provision
Litter and waste disposal arrangements
Expected noise levels and times
Fire and health and safety risk assessments
Emergency vehicle access and site evacuation plan
2.15 The premises licence holder shall ensure, including via the hiring agreement documentation, that all event organisers are alerted to the Health and Safety Executive guidance document ‘The Event Safety Guide’ HSG195 (or any successor publication thereof). The premises licence holder shall monitor compliance before and during the event so far as is reasonably practicable.
2.16 The Management Plan must be agreed between the event organiser/premises user and the premises licence holder prior to the commencement of a licensable. When the event is new to the venue or the management plan changes significantly from a previous staging of the event, the management plan will be communicated to the Licensing Authority at least 2 (two) months prior to the event date so that they and other responsible authorities may be given the opportunity to comment or advise.
2.17 When amplified music is to be played at an outside event, whether inside a temporary structure or not, and if the location is within 500m of the nearest domestic property, a noise limiter shall be fitted to the amplifier with the trigger level agreed with the Environmental Protection Department of the Licensing Authority and their complaints protocol shall be observed.
2.18 Overnight camping shall not be permitted other than to event staff, exhibitors or participants in enthusiast rallies and only in motor-homes or tents, not in towed caravans or trailers. This shall be located in a designated area outside the contained event area
