ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
4. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
5. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
6. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
7. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
8. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE:
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
General
1. All bar staff will be trained in the basic law relating to the sale/supply of alcohol and a record of who has received this training will be kept at the premises.
2. There will be a 30 minute “chill out” period after all licensed activities cease before the premises are closed.
There are embedded conditions contained in the Licensing Act 1964 and the Children and Young Persons Act 1933.
Liquor or licence condition 1: That alcohol only be sold to those attending pre-booked function, partaking of substantial refreshments or staying at the hotel.
Liquor licence condition: To be declared final within 6 months (declared final)
The prevention of crime and disorder
1. The Licensee, that is the person in whose name the premises licence is issued, shall ensure that at all times when the premises are open for any licensable activity, there are sufficient, competent staff on duty at the premises for the purpose of fulfilling the terms and conditions of the licence and for preventing crime and disorder.
2. All members of staff at the premises shall seek “credible photographic proof of age evidence” from any person who appears to be under the age of 18 years and who is seeking to purchase or consume alcohol on the premises.
3. A suitably worded sign of sufficient size and clarity must be displayed at the point of entry to the premises and in a suitable location at any points of sale, advising customers that they may be asked to produce evidence of their age.
4. The Licensee shall not advertise, promote, sell or supply alcoholic drinks in such a way that is intended or likely to encourage persons to consume alcohol to an excessive extent.
5. The Licensee shall not sell or supply alcoholic drinks in such a way which will enable, or which is intended to enable, persona to consume unlimited quantities of alcoholic drinks on payment of a single payment or a payment arrangement which is not related to the quantity or volume of alcoholic drinks supplied.
6. The Licensee shall not sell or supply alcoholic drinks at prices less than the “ agreed minimum prices”.
7. Suitably phrased, clear and conspicuous notices, shall be displayed near the entrance to the premises and in other appropriate locations such as sanitary conveniences advising patrons;
i. Of any risk of theft or possibility of other criminal activity. And/or
ii. To exercise care with their personal possessions to prevent theft. And/or
iii. How to report any incidents of theft or other criminal activity.
8. All signs required under these conditions shall be illuminated or positioned in well-lighted locations.
9. External lighting to exterior and car park.
10. Doors to be closed, access by key holder only after 24:00 hours
Public safety
1. When obviously physically disabled people are present, adequate arrangements must exist to enable their safe evacuation in the event of an emergency.
2. All fire doors must be maintained effectively self closing and must not be held open other than by approved devices.
3. Fire fighting equipment must be provided in the licensed premises in accordance with the risk assessment with staff suitably trained as necessary.
4. Curtains, hangings and temporary decorations must be arranged so as not to obstruct exits, fire safety signs or fire fighting equipment.
5. Adequate and appropriate equipment must be provided for enabling first aid to be rendered to members of the public if they are injured or become ill whilst at the licensed premises.
6. In the absence of adequate daylight, the lighting in any area accessible to the public must be fully in operation when they are present.
7. No alterations must be made to the premise which makes it impossible to comply with an existing licence condition without first seeking a variation of the premises licence proposing the deletion of the condition in question. The applicant will need to propose a new operating schedule reflecting the proposed alteration to the premises and how he or she intends to take alternative steps to promote the public safety objective and amend the risk assessment accordingly.
8. Hangings, curtains and temporary decorations must be maintained in a flame retardant conditions.
9. A responsible person where there is an outbreak of fire must raise the alarm, evacuate the building, and call the fire brigade. Following the incident, a responsible person must ensure that the details are recorded in a Fire Log Book. Any remedial work necessary to restore fire precautions to their original standard must be adequately illuminated.
10. Fire safety signs must be adequately illuminated.
11. Emergency lighting must not be substantively altered without prior consent of the Licensing Authority.
12. In the event of the failure of normal lighting, where the emergency lighting battery has a capacity of one hours, arrangements must be in place to ensure that the public leave the premises immediately. Where the emergency lighting battery has a capacity greater than one hour.
Note:
a) In addition an investigation into any failure of the system must be carried out to ascertain whether it is safe for persons to remain in the premises when only the emergency lighting is operating.
b) Emergency lighting installations must comply with 5266 or equivalent standard.
The prevention of public nuisance
1. Premises must remove their waste and refuse in a timely manner to a licensed waste and disposal facility.
2. An adequate member of staff must monitor the activity of persons leaving the premises and remind them of their public responsibilities where necessary.
3. Noise generated by amplified music must be controlled by a noise limiting device set at a level determined by the Local Authority Environmental Health Officer, such level being confirmed in writing to the Licensee.
4. Suitable ventilation and extraction systems must be provided to eliminate noxious odours. Such systems must be maintained on a regular basis.
5. Premises must enter into a waste removal agreement with a licensed waste disposal contractor and keep documented evidence of the agreement.
6. Empty bottles must be stored in a lidded skip within the curtilage of the premises prior to collection. Operationally bottles must be removed from the public area on a frequent basis and transferred to the skip. It is recommended that transfer to an external skip must not be undertaken after 23:00 to minimise noise disturbance to adjoining properties.
7. There must be clear and legible notices displayed at exits and other circulatory areas requesting patrons to leave the premises having regard to the needs of local residents, in particular emphasising the need to refrain from shouting and slamming car doors. The sounding of car horns must also be discouraged.
8. The function room is double glazed and air conditioned.
The protection of children from harm
1. All members of staff at the premises shall seek “credible photographic proof of age evidence” from any person who appears to be under the age of 18 years and who is seeking to purchase or consume alcohol on the premises.
2. A suitable worded sign of sufficient size and clarity must be displayed at the point of entry to the premises and in a suitable location at any points of sale, advising customers that they may be asked to produce evidence of their age.
3. No children under the age of 18 years must be allowed access to that part of the premises during times where any activity or entertainment of a sexual nature is being provided. For the purposes of this condition, entertainment of a sexual nature includes but is not limited to striptease (sometimes referred to as exotic dancing) lap dancing, pole dancing or any other entertainment of a similar nature.
4. No children under 18 must be admitted to any entertainment of an adult nature. For the purpose of this condition entertainment is regarded as being adult entertainment if it includes foul or abusive language, nudity or violence or which is likely to offend against good taste or decency....
