Annex 1 - Mandatory conditions General condition: |
(1) The admission of children to the exhibition of any film is to be restricted in accordance with this section. (2) Where the film classification body is specified in the licence, unless subsection (3) (b) applies, admission of children must be restricted in accordance with any recommendation made by that body. (3) Where: (a) the film classification body is not specified in the licence, or (b) The relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question; admission of children must be restricted in accordance with any recommendation made by that licensing authority. (4) In this section: "children" means persons aged under 18; and "Film classification body" means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c. 39) (authority to determine suitability of video works for classification). |
Annex 2 - Conditions consistent with the operating schedule
Prevention of Public Nuisance
1. All external doors and windows to rooms in the building in which amplified music/speech is played shall be kept closed during the entertainment activity, save to permit access to and egress from the building. All such doors shall be fitted with self-closing devices. Appropriate air conditioning shall be installed if considered appropriate by the premises licence holder to secure compliance with this condition.
2. The premises licence holder shall take all reasonable steps and precautions to minimise the risk of disturbance or nuisance to neighbouring properties caused by events or attendees at the licensed premises (whether through people noise, entertainment noise, vehicular noise, waste disposal, event set-up or breakdown, littering or noxious odour). This shall include a risk assessment of where is the most appropriate location at the licensed premises to host a particular type of licensable activity or event.
3. A minimum of once an hour, staff on duty shall monitor key-card access/exit areas and supervise behaviour of congregations of licensed premises attendees - given the potential for mixing of the venue’s attendees with residents/guests of the adjoining YMCA and potential for unauthorised access to the licensed premises. Staff shall check the whole outside of the building at least once every hour for anti-social behaviour, and shall at the earliest practicable opportunity deal with any dispersal issues and complete the incident log as necessary.
4. Notices shall be prominently displayed and maintained on the premises requesting that attendees/users of the licensed premises leave the premises and the vicinity quietly and with respect to the needs of neighbouring properties.
5. All refuse and waste shall be disposed of in an appropriate manner, at such times and by such methods, so as to minimise any potential for causing public nuisance.
6. The premises licence holder shall ensure that staff maintain all external areas of the premises in a clean and presentable manner at all times.
7. The premises licence holder or their nominated representative shall ensure that a competent individual shall, hourly, survey noise outbreak from the licensed premises whilst regulated entertainment is being provided. An accurately calibrated portable decibel meter shall be used for this purpose where such equipment is available to the premises licence holder. Where the noise or vibration level is such that it is likely to cause disturbance to residential properties, he/she shall decrease the volume level accordingly. Where excessive noise is detected, details of the checks including date, times and actions taken are to be legibly recorded in a logbook for that purpose kept of the licensed premises with records retained for a minimum of two years from the date of the logbook entry. The logbook shall be made available upon request to an authorised officer of the Police or Licensing Authority.
Protection of Children from Harm
8. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
9. Children shall only be permitted on the licensed premises during licensed activities or events where accompanied or under the supervision of an adult.
10. During any performance or activity for children a ratio of at least one attendant for every 25 (twenty-five) children present shall be maintained. Suitable and sufficient emergency evacuation procedures shall be in place to ensure safe and controlled exit in the event of an emergency situation (including clearly communicated assembly points).
11. The premises licence holder shall have in place a Child and Vulnerable Adult Policy which shall require all relevant volunteers to have been suitability vetted for criminal records and barring from working with children or vulnerable adults. External groups/hirers and/or clubs specifically for children shall be required to satisfy the premises licence holder of their arrangements for protecting children and vulnerable persons.
Public Safety
12. Notices shall be prominently displayed and maintained on the licensed premises advising of the maximum safe occupancy limit for the building. The capacity of persons on the premises shall be monitored and controlled to ensure compliance.
13. The premises licence holder shall ensure that notices detailing emergency evacuation procedures are prominently displayed and maintained on the licensed premises. Adequate arrangements shall be in place to ensure the safe evacuation of any disabled persons on the premises. All exits points shall be maintained so they are free from obstruction or hazard.
14. For events involving licensable activities, the premises licence holder shall conduct a suitable and sufficient risk assessment and ensure that adequate provision of trained first aid personnel and first aid equipment are made available on the premises - commensurate with the nature and scale of the event and risk assessment outcome.
15. Lighting and emergency lighting shall be installed and maintained so as to ensure that good levels of visibility are maintained whilst the premises are being used for licensable activities and the public are on the premises. External lighting should be of such specification and positioning so as to meet this objective without causing any public nuisance by light pollution.
16. A minimum of 2 (two) competent attendants shall be on duty at the licensed premises, in addition to the main hirer/user, throughout all hiring’s or events involving licensable activities so as to assist people entering and leaving the venue. No attendant used for this purpose shall be under 18 (eighteen) years of age. All persons on duty shall have been instructed in their responsibilities in the event of fire or other emergency situation,
including attention to disabled persons, the location of the firefighting equipment available, how to call the fire service and evacuation procedure including the location of the emergency evacuation assembly point.
Prevention of Crime and Disorder
17. No illegal drugs shall be permitted on the premises, and all hirers/users made aware of a zero tolerance to drugs on the premises. Notices shall be prominently displayed and maintained in respect of this matter.
18. Event attendees shall not be permitted to bring their own alcohol onto the licensed premises, unless the premises licence holder has given their express prior consent in writing and it is part of a specific function authorised by the premises licence holder. Where regulated alcohol activity is to take place it must be appropriately authorised under the Licensing Act 2003 (whether Temporary Event Notice) or other separate permission.
19. Staff shall be appropriately trained in monitoring attendees for any signs of intoxication or drug use. All instances of unauthorised and underage possession or consumption of alcohol, or drugs, shall be challenged with the police promptly notified in relation to any instances. Where any unauthorised alcohol or illegal substances are found it shall be confiscated and retained in a secure deposit box and the police shall be notified within 48 (forty-eight) hours.
20. All requests for hiring are of the licensed premises for licensable activities shall be scrutinised by the premises licence holder prior to a decision on whether the hiring shall be permitted or not. The nature of the event, numbers anticipated, audience age and profile and any previous history linked to the hirer or event shall be diligently reviewed as part of this determination and record kept of that process.
21. Policies and logs will be written for the premises relating to the following categories:
Fire safety and emergency evacuation plan
Banning policy
Prohibited items policy
Dispersal policy
Search policy
Hiring and vetting policy
Smoking area policy
Disorder and ejection policy
CCTV policy and procedure
Customer complaints policy
Incident report form
Capacity log and signing in register for young people
Banned log
CCTV log
Ladies toilet check log
Gents toilet check log
Children/safeguarding policy
22. These policies and logs shall be maintained so as up to date, accurate, relevant and subject to annual review. A copy of each policy shall be submitted to and approved by the Police and Licensing Authority by the end of January 2015, and subsequent revisions shall be submitted to those authorities within 28 (twenty-eight) days of being made.
23. Toilet areas shall be checked at least once every hour whilst the premises are open for licensable activities. A ‘toilet-check’ log book shall be legibly and accurately endorsed to this effect and made available to police or an authorised officer of the licensing authority immediately upon request. Staff shall be diligent to monitor toilet areas for signs of, and to prevent, drug taking as well as public safety issues.
24. The premises licence holder shall ensure that CCTV shall be installed and maintained at the licensed premises provided in the form of a recordable system, capable of providing pictures of evidential quality in all lighting conditions (particularly facial recognition). Cameras shall encompass all entrance and exit points to the premises, fire exits, outside areas (including designated smoking areas) and all recordings shall also be made a minimum of 30 (thirty) minutes before and 30 (thirty) minutes after the times when the public are on the premises. CCTV equipment shall be maintained in good working order and be correctly time and date stamped. Recordings shall be kept in date order, numbered sequentially and kept for a minimum period of 28 (twenty-eight) days and made available on request and in any event within 36 (thirty-six) hours to an authorised officer of the Police or Licensing Authority.
25. The premises licence holder shall ensure that at all times an appointed member of staff is capable of and competent at downloading CCTV footage in a viewable format onto disc or storage device. The recording equipment and media shall be kept in a secure environment under the control of a responsible named individual. In the event of technical failure of the CCTV equipment the premises licence holder shall report the failure to the Police and Licensing Authority immediately. It should be noted that any retention, use or disclosure of personal information captured on CCTV must be carried out in line with data protection principles, which shall override any conflicting element of this condition and condition 24 above.
26. No entry to the licensed premises shall be permitted to attendees who appear to be under the influence of alcohol or substances.
27. Staff employed for supervising licensable activities shall be suitably and sufficiently trained in all policies and record-keeping requirements. Such training details shall be logged, recorded and made available for inspection.
