1. Annex 1- Mandatory Conditions
Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor (DPS) in respect of the premises licence, or
(b) At any time when the designated premises supervisor (DPS) does not hold a personal licence or his/her personal licence is suspended.
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
1. Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
1. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
2. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
3. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
4. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
5. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
6. The relevant person (the holder of the premises licence, the designated premises supervisor (if any) in respect of such a licence, the personal licence holder who makes or authorises a supply of alcohol under such a licence, or any member or officer of a club present on the premises in a capacity which enables the member or officer to prevent the supply in question) shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
For the purposes of this condition “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979, “permitted price” is the price found by applying the formula -
P = D + (D x V)
where - (i) P is the permitted price, (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii)
V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
[“value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994]
Annex 2 - Conditions Consistent with the Operating Schedule
General
1. The premises licence holder shall create and implement an Event Management Plan (EMP) to promote the licensing objectives for each event involving licensable activities. A final version of the EMP and up to date site plans shall be sent by the premises licence holder to the Licensing Authority and all Responsible Authorities no later than 28 (twenty-eight) days prior to the first day of the event. Any proposed revisions to the EMP shall be agreed in writing with the relevant Responsible Authority before the master EMP is updated - which shall be as soon as reasonably practicable following the revision being agreed. The premises licence, event management plan and risk assessments shall be kept with all other event documentation in the event control for the duration of the festival and this location shall be clearly identified on the site plan.
2. The premises licence holder shall ensure that a robust hiring process and agreement is in place for third party hiring requests to include licensable activities, so as to ensure promotion of the licensing objectives.
Prevention of Crime and Disorder
3. For events involving licensable activities, the premises licence holder shall ensure that adequate numbers of security personnel and competent stewards are deployed on site - commensurate with the nature and scale of the event.
4. For events including the use of marquees at any time, all alcoholic drinks shall be decanted to plastic or toughened glass vessels before being served. Alcoholic beverages shall not be available to customers in glassware or glass bottles. Campers and other event attendees bringing their own food and beverages onto the site shall be advised to not litter the site or leave glass or bottles unattended in public areas.
5. Staff shall receive suitable training, including refresher training at least once every six months, in relation to promotion of the licensing objectives, including licensing offences, social responsibility in respect of alcohol sales and the premises licence holder’s policies and practices. All training shall be recorded and details made available upon request to an authorised officer of the Licensing Authority or Police.
Public safety
6. Outdoor events involving licensable activities shall be restricted to not more than 7,500 persons, including performers, management, stallholders, staff and volunteers.
7. A two-way radio and communications system shall be utilised amongst all key staff connected with the management of the event including the stewards, security and first aid personnel.
8. The premises licence holder shall ensure that a competent designated event safety officer is on duty for the duration event, with that individual tasked to co-ordinate any emergency response required in the event of a public safety incident.
9. For events involving licensable activities, the premises licence holder shall ensure that adequate provision of trained first aid personnel and first aid equipment are made available - commensurate with the nature and scale of the event.
10. The premises licence holder shall ensure that traffic is adequately managed, signed and directed so as to ensure the safe access and egress of vehicles at the site.
11. All stewards shall be fully briefed on the emergency plan and public safety measures in place for the event prior to the commencement of any licensable activity.
12. All exits routes from the performance site shall be clearly signed, with exits kept unobstructed.
13. The premises licence holder shall ensure that suitable and sufficient public safety checks and risk assessments of the site are completed, and determined satisfactory, prior to any admission of the public to the licensed premises.
14. The premises licence holder shall ensure that adequate arrangements exist for the safe evacuation of any disabled persons on the licensed site, in the event of an emergency situation. Persons on the site for the performance shall be made aware of evacuation procedures by the premises licence holder.
Prevention of Public Nuisance
15. Notices shall be prominently displayed and maintained on the licensed premises asking patrons to leave the premises and the area quietly.
16. The car park shall be adequately illuminated during the hours of darkness whilst licensable activities are taking place on the licensed premises. Lighting and emergency lighting shall be installed and maintained so as to ensure that good levels of visibility are maintained whilst the premises are being used for licensable activities.
Protection of Children from harm
17. The premises licence holder shall adopt a ‘Challenge 25’ proof of age scheme. The premises licence holder shall operate a requirement for the production of a passport, driving licence or other bona fide form of identity carrying a photographic image, where the individual requesting the supply of alcohol appears to be under the age of 25.
18. Children under the age of 12 shall not be permitted to remain on the licensed premises during licensed activities or events unless they are accompanied by an adult at all times.
19. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
20. The premises licence holder shall operate a suitable and sufficient child protection and welfare policy within the event management plan and this shall incorporate a clear and well communicated protocol for dealing with lost children and checking/vetting of any person given a role involving the care, supervision or welfare of children.
21. For outdoor events a designated ‘lost children’ point shall be identified and communicated/signed.
22. The premises licence holder shall ensure that all staff and volunteers who may have a child protection role (for example reuniting lost children with their accompanying adult) shall be subject to prior criminal records checking, where this is permissible under the Disclosure and Barring Service (DBS) scheme.
Annex 3 - Conditions attached after a hearing by the licensing authority
Licensing Sub-Committee Decision on 9 October 2014 following the hearing of 3 October 2014
1 There shall be no more than two (2) events per calendar annum involving licensable activities for 5,000 or more persons. No event shall exceed 7,500 persons at any one time - including staff, performers or contractors.
2 There shall be not more than 60 (sixty) event days involving licensable activities on the licensed site during any one calendar year. The part of any day on which an event takes place shall count as one event day for the purposes of this limitation. The number of smaller scale non-event day activities involving one or more licensable activity shall not be limited by this condition. For the avoidance of doubt an “event day” for the purposes of this condition is a licensable activity involving a maximum of 4,999 persons.
3 There shall be not more than 2 (two) events involving one or more licensable activity staged simultaneously on the licensed site for more than 2500 (two thousand five hundred) persons at any one time per event.
4 For all outdoor public events or hirings involving one or more licensable activity, the premises licence holder shall ensure that a suitable and sufficient Noise Management Plan (NMP) is created, documented and agreed with Mid Suffolk District Council’s Environmental Protection Team (EPT) at least 28 days before the event is scheduled to take place. Where appropriate the NMP shall be incorporated with, or appended to, the Event Management Plan (EMP) and risk assessments for the relevant event.
5 The premises licence holder shall create and implement an Event Management Plan (EMP) for each event involving licensable activities which are likely to attract an attendance of 500 or more persons. As a minimum this shall include the following aspects of the event:
Nature of the event and range of licensable activities intended
A site plan delineating the contained area of licensable activities and of car parking
Event open timings and set up and build down programme
Expected attendance numbers
Traffic and parking control
Marshalls, stewards, security or crew numbers
Child safety and protection measures
Temporary structures and equipment
Compliance with the Licensing Act 2003 and promotion of the four licensing objectives
Catering facilities and hygiene
Toilets and first aid facilities/ medical provision
Litter and waste disposal arrangements
Expected noise levels and times
Fire and health and safety risk assessments
Emergency vehicle access and site evacuation plans
For avoidance of doubt this condition shall also meet the requirements relating to EMP conditions contained within Annex 2 of the licence.
1 To promote public safety and the prevention of public nuisance, the premises licence holder shall prohibit the use of all airborne launched lanterns, latex balloons and similar free-floating devices containing a naked flame, fuel cell, helium gas or similar elevation mechanism - whether the device is specified as bio-degradable or otherwise. Such lanterns or devices are commonly known as Chinese Lanterns, Sky Lanterns, Flying Lanterns, Glowing Lanterns, Night Sky Lanterns, and Kongming Lanterns or similar. For the avoidance of any doubt static, fixed, hanging or waterborne ornamental or decorational lanterns, balloons or similar devices are not explicitly prohibited by this condition and consideration of such matters shall be for the event organiser’s own risk assessment.
2 The maximum number of persons (including staff, performers, contractors, residents and stallholders) on the licensed site during any licensable activity on any part of the site shall not cumulatively exceed 7,500 (seven thousand five hundred) at any one time. In compliance with this condition no single event involving one or more licensable activity shall exceed 7,500 persons on the licensed site at any one time. For the avoidance of doubt, where any lesser maximum capacity is set under any separate regulation or risk assessment then the lesser figure shall apply to the event.
3 There shall be no late night refreshment for takeaway consumption beyond the perimeter of the licensed premises.
4 The premises licence holder shall ensure, including via any hiring agreement documentation, that all event organisers are alerted to the Health and Safety Executive Guidance document “The Event Safety Guide” HSG195 (or any successor publication thereof). The premises licence holder shall monitor compliance before and during the event so far as is reasonable practicable.
5 The premises licence holder shall ensure that all event organiser(s) provide contact details of their service or activity providers and the name of the main event organiser(s). The premises licence holder shall ensure that the event organiser(s) is/ are clearly advised of their responsibilities in relation to the promotion of the licensing objectives and risk assessments. Prior to the commencement of the event the premises licence holder shall notify the event organiser(s) of all site particulars, including any prohibitions, and shall require sight of the event organiser(s) risk assessment (including any special activity risk) documentation for all events involving licensable activities.
6 All hirers, event organisers and suppliers/ contractors shall be made aware of the premises licence terms and conditions by the premises licence holder prior to the commencement of a licensable event or activity.
7 During operating hours, the premises licence holder, designated premises supervisor (DPS) or other responsible person nominated by the premises licence holder or the DPS shall be available to receive and respond to any nuisance related complaints (or similar) whilst the events are taking place. A contact telephone number shall be provided to the Licensing Authority and Environmental Protection Team for that purpose prior to the first day of any licensed event. The contact telephone number and details of the nominated representative shall also be published on any website which is maintained by the licence holder prior to the first day of any licensed event and for the duration of said event.
8 The premises licence holder shall create and implement a detailed logbook which shall record all instances of complaints received and actions taken, the logbook shall be duly signed and dated by the designated premises supervisor or manager and produced to an authorised officer of the local authority immediately upon request. The detailed logbook shall be kept at the licensed premises for a minimum period of 1 (One) year from the final entry date.
9 During any performance or activity for children a ratio of at least two attendants for every fifty children present shall be maintained. Suitable and sufficient emergency evacuation procedures shall be in place and adequately communicated.
The Sub-Committee amended the operating schedule in relation to capacity as stated below
Where conditions in the operating schedule in part M of the application refer to 9,999 persons this shall now read 7,500 persons.
