Annex 1- Mandatory Conditions
1. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
2. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
3. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
4. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
5. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
6. The relevant person (the holder of the premises licence, the designated premises supervisor (if any) in respect of such a licence, the personal licence holder who makes or authorises a supply of alcohol under such a licence, or any member or officer of a club present on the premises in a capacity which enables the member or officer to prevent the supply in question) shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
For the purposes of this condition “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979, “permitted price” is the price found by applying the formula -
P = D + (D x V)
where - (i) P is the permitted price, (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii)
V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
[“value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994]
Annex 2 - Conditions consistent with the Club operating schedule
The club shall have in place a Child and Vulnerable Adult Policy which shall require all relevant volunteers to have been suitability vetted for criminal records and barring from working with children or vulnerable adults.
Suitable and sufficient signage shall be displayed and maintained on the club premises in relation to anti-drugs policy and general drugs awareness.
The club Committee shall ensure that the number of hiring’s of the club premise for members functions shall not exceed 25 (twenty five) per calendar year. For the avoidance of doubt, this limitation is separate to the entitlements provided for by the Temporary Event Notice (TEN’s) system for public licensable events or any club licensable activities not authorised by Club Premises Certificate MCP0022.
All sales of alcoholic beverages shall be made, and payment taken directly over the bar.
The club executive committee shall ensure that a legible written record is maintained stating the actual opening times and closing times of the premise.
All prospective hiring’s of the club facilities shall be reviewed and agreed by the club executive committee before consent is given by the club to the hirer. A legible written record of all such agreements (whether it be member’s hiring or TEN’s hiring’s) shall be kept and made available upon request to the Licensing Authority or Police.
Any hirer of the club facilities shall be at least 25 years old and shall be present throughout the function. The club shall ensure that this condition is made sufficiently clear to all hirers at the time of the booking. Contractual records of all booking made shall be kept and made available upon request to the Licensing Authority.
The Club shall operate a disciplinary process to ensure that members and their guests are banned/excluded from the club premises where the club consider it to be necessary.
The car park shall be adequately illuminated during the hours of darkness whilst licensable activities are taking place on the licensed premises.
The club shall ensure sufficient of-road parking and will actively discourage any roadside parking.
The club shall ensure that suitable and satisfactory public safety risk assessments are undertaken with outcomes to be legibly recorded in a log-book maintained for that purpose.
There shall be no performances or activities on the licensed premises which involve any elevated risk of danger to the public.
The club shall ensure that highly flammable substances are not permitted to be bought into the premises and any chemicals or fuel required for ground maintenance is stored in a secure and locked facility.
The club shall conduct a suitable and sufficient risk assessment and ensure that adequate provision of trained first aid personnel and first aid equipment are made available on the premise.
All external doors and windows to rooms in the building in which amplified music/speech or regulated music activity is played taking place after 19:00hrs shall be kept closed during the entertainment activity, save to permit access and egress from the building.
The club shall take all reasonable steps and precautions to minimise the risk of disturbance or nuisance to local residents caused by events or attendees at the licensed premises (whether through people noise, entertainment noise, vehicular noise, waste disposal, event setup or breakdown, littering or noxious odour).
The club shall ensure that close residents are kept informed of the programme of events to be held at the licensed premises. It is recommended that the programme be published on any website for the premises and be displayed and kept updated in the immediate vicinity of the premises.
The club shall ensure that volume levels from both live and recorded music are monitored by the responsible person throughout the duration of the activity. Monitoring shall take place both inside and outside of the licensed premises and due regard shall be had to whether the activity may lead to excessive noise at neighbouring properties. Appropriate remedial steps shall be taken, and recorded, in the event of any excessive noise levels being experienced.
Clear and legible notices shall be prominently displayed at exits and other public areas of the premises requesting that patrons have due regard to the needs of local residents.
Waste from the club premises shall be removed in a timely manor (outside the hours of 11pm and 7am) to an appropriate waste disposal facility, so as to minimise the risk of public nuisance.
The cub shall ensure that a Child Welfare Officer is a member of the club Executive Committee and also the General Committee, and that all junior training sessions are overseen by BDS approved coaches.
There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the club premises that may give rise to concern in respect of children.
The club management shall adapt a ‘Challenge 21’ proof of age scheme and operate a requirement for the production of a passport, driving licence or other bona fide form of identity carrying a photographic image, where the individual requesting the supply of alcohol appears to be under the age of 21. The club management shall prominently display and maintain notices at the club premises relating to this policy.
If underage drinking is found to be occurring at a private function then the function shall be closed down with immediate effect. If it is established that a club member is responsible for the offender then the club member shall face club disciplinary proceedings.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY:That the bar is made fully secure by the provision of bar shutters which will protect the stock from theft outside the hours during which the licensable activities are permitted to take place (for the prevention of crime and disorder).
That the applicants are to ensure that at all times the Club is in operation that members of the Battisford and District Cricket Club and guests to the Club park their motor vehicles in the club car park provided and in accordance with club’s requirements as to proper car parking (for the prevention of public nuisance).
That there is provided within the bar area signage indicating that any club member buying or attempting to buy alcohol for consumption by persons under 18 years of age will be permanently banned from club premises (for the protection of children from harm).
