Annex 1- Mandatory Conditions
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor (DPS) in respect of the premises licence, or
(b) At any time when the designated premises supervisor (DPS) does not hold a personal licence or his/her personal licence is suspended.
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
4. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
5. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
6. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
7. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
8. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
9. The relevant person (the holder of the premises licence, the designated premises supervisor (if any) in respect of such a licence, the personal licence holder who makes or authorises a supply of alcohol under such a licence, or any member or officer of a club present on the premises in a capacity which enables the member or officer to prevent the supply in question) shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
For the purposes of this condition “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979, “permitted price” is the price found by applying the formula -
P = D + (D x V)
where - (i) P is the permitted price, (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii)
V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
[“value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994]
Annex 2 - Conditions consistent with the operating schedule
General
The club has a long established and good relationship with the surrounding community and the Police.
The prevention of crime and disorder
The premises licence holder is to in force a Zero tolerance policy on drugs.
The premises licence holder is and will remain a member of Pub Watch and the Radio Link initiative.
The premises licence holder will alert the police immediately if they thought anybody to be under the influence of drugs.
Where drugs are found on the premises the premises licence holder or designated person will immediately report this to the police and place these in the club safe until police arrived. The premises licence holder or designated person will maintain a register concerning drugs, which is to be kept on the premises.
The premises licence holder will employ door supervisors at specific functions and events when they consider them necessary to:
Prevent the admission and ensure the departure from the premises of drunk and disorderly persons;
Keep out excluded individuals (subject to court or pub watch bans); and
Search and exclude persons suspected of carrying illegal drugs or offensive weapons.
The premises licence holder will employ door supervisors at functions and events specifically for 18 to 24 year old persons.
The premises licence holder will make sure that a female door supervisor is used if searches are to be conducted on female customers.
The premises licence holder will install CCTV equipment both inside and outside of the premises and they will ensure that it is maintained in working order.
The premises licence holder or designated person will set the CCTV equipment to record from the time that the premises is open until the time that the premises close which must include that all members of the public have left the premises.
The premises licence holder of designated person will ensure that any cameras covering the exterior of the premises are left to record upon activity detection.
The premises licence holder will ensure that CCTV data is retained for at least twenty eight days and must be produced to the Police or an authorised officer of the Licensing Authority upon request.
The premises licence holder will place notices on the premises which are clearly visible to the public stating that CCTV has been installed on the premises.
The premises licence holder or designated premises supervisor will ensure that any person supplying an alcoholic drink requests a proof of age ID which is photographic, where they have reason to suspect that an individual may be under the age of 18 years old.
The premises licence holder will implement and maintain a prohibited substances policy which has been agreed in conjunction with the Police.
The premises licence holder will ensure that a secure deposit box is kept on the premises for the retention of confiscated items of prohibited substances and must ensure that the Police are advised on any items which require safe disposal.
The premises licence holder shall ensure that any public information notices about crime and disorder issues are displayed at the request of the Police or the Licensing Authority.
The premises licence holder shall be responsible for the disposal of waste on the frontage of the premises and will make provision for the emptying of litter bins in the immediate vicinity of the premises.
The premises licence holder shall ensure that for the duration of any outside events, polycarbonate drinking vessels will be used at all times and that no drinks will be served/dispensed in glasses or glass bottles. The premises licence holder will ensure that for outside events our security staff monitor this and ensure no glass is allowed outside.
Public safety
The premises licence holder is to undertake regular Health and Safety and Fire assessments.
The premises licence holder will make sure that escape routes and exits, including external exits, are maintained to ensure that they are not obstructed, in good order with non-slippery and even surfaces, free of trip hazards and are clearly identified.
The premises licence holder will make sure that where chairs and tables are provided, internal gangways are kept unobstructed at all times.
The premises licence holder will make sure that hangings, curtains and temporary decorations are maintained in a flame-retardant condition.
The premises licence holder will make sure that any upholstered seating meets on a continuous basis the pass criteria for smouldering ignition source 0, flaming ignitions source 1 and crib ignition source 5 when tested in accordance with section 5 of Bs 5852:1990.
The premises licence holder will make sure that hangings, curtains and temporary decorations are arranged so as not to obstruct exits, fire safety signs or fire-fighting equipment.
The premises licence holder shall ensure that access for emergency vehicles is kept clear and free from obstruction.
The premises licence holder will make sure that when disabled people are present, adequate arrangements exist to enable their safe evacuation in the event of an emergency.
The premises licence holder will make sure that an adequate and appropriate supply of first aid equipment and materials is available on the premises.
In the absence of adequate daylight, the premises licence holder will make sure that the lighting in any area accessible to the public is fully operational.
The premises licence holder will make sure that Fire safety signs are adequately illuminated.
The premises licence holder shall ensure that they have a valid public liability insurance in force and that a copy of the schedule is available for inspection by the Police or an authorised officer of the Council.
The prevention on public nuisance
The premises licence holder will make sure that any request by an authorised officer of the Council in relation to reducing noise levels is complied with.
The premises licence holder will ensure that no amplified sound (including public announcements) in connection with the event continues beyond the permitted hours of the entertainment.
The premises licence holder will ensure that offensive smells from the licensed premises are not permitted so as to cause a nuisance to nearby properties and that the premises are properly vented.
The premises licence holder shall ensure that receptacles for waste are emptied regularly to minimise nuisance smells.
The premises licence holder will provide adequate and suitable receptacles to receive and store refuse from the premises /site.
The premises licence holder will make sure that receptacles for refuse storage are maintained in a clean condition.
The premises licence holder will make sure litter is regularly cleared from the vicinity of the premises.
The protection of children of harm
The premises licence holder is CASC registered. The Rugby and Cricket sections of the club have "Seal of Approval" status from their regulatory bodies. The Football section has "Charter Standard Status". Any adults with close interaction with children are CRB checked.
The premises licence holder shall implement and maintain a crime prevention policy which has been agreed in conjunction with the Police.
Annex 3 - Conditions attached after a hearing by the licensing authority
1. All windows and doors are to be kept closed during events which involve the use of music, whether amplified or acoustic and throughout the showing of films, except for access to and egress from the premises with all external doors fitted with self closing devices.
2. Any external lighting must be angled downwards to maximise the light in the area where people need to see, and to minimise the risk of light pollution to nearby residents.
3. Any loudspeakers or amplification equipment must at all times face away from the boundary closest to the noise sensitive dwellings.
4. All outdoor licensable activities which include plays, live and recorded music, dance, the making of music and any other similar activities shall cease at 22:30 hours.
5. There shall be a maximum of 6 outdoor events per annum with a minimum period of 21 days between events except for the StowFest event which shall itself count as one event.
6. A log or diary record must be kept of all outdoor events.
