Annex 1 - Mandatory conditions
General Condition
1. (a) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
(b) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
(c) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either -
(i) a holographic mark, or
(ii) an ultraviolet feature.
General Condition
1. The relevant person (the holder of the premises licence, the designated premises supervisor (if any) in respect of such a licence, the personal licence holder who makes or authorises a supply of alcohol under such a licence, or any member or officer of a club present on the premises in a capacity which enables the member or officer to prevent the supply in question) shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
For the purposes of this condition "duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979, "permitted price" is the price found by applying the formula -
P = D + (D x V)
where -
(i) P is the permitted price,
(ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and
(iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol; [“value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994]
General Condition
(1) No supply of alcohol may be made under the premises licence:
(a) at a time when there is no designated premises supervisor in respect of the premises licence; or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(2) Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Annex 2 - Conditions consistent with the Operating Schedule
The premise licence holder shall ensure that the area will be managed and supervised at all times by management and store staff.
The premise licence holder shall engage with community police/Safer Neighbourhood Team regarding any prevalent local crime and disorder issues, and shall implement any reasonable steps recommended by the Police to promote the prevention of crime and disorder at and in the vicinity of the licensed premises.
CCTV shall be installed and maintained providing good image quality and covering all internal areas of the licensed premises to which the public have access, together with all entrances and exits. Images are retained for a minimum period of 28 days. It should be noted that any retention, use or disclosure of personal information captured on CCTV must be carried out in line with data protection principles.
The premise licence holder shall ensure a member of staff available to download CCTV footage/images and provide copies to the Police and an authorised officer of the Licensing Authority upon demand and in any event within 24 hours of any such request.
Suitable signage shall be displayed and maintained on the licensed premises advising customers that CCTV is in operation.
Management will escort from the premises any person who appears intoxicated
All staff shall be trained in the prevention of sales of alcohol to underage or drunken persons and a record of such training shall be retained at the premises and made available to the Police and an authorised officer of the Licensing Authority on demand.
A refusals book shall be operated and maintained on the licensed premises to record all instances of refused sales of alcohol and which shall be made available to the Police and an authorise officer of the Licensing Authority on demand.
High value alcoholic drinks shall be stored/displayed behind the counter in order to promote the prevention of crime and disorder.
An incident book shall be operated and maintained on the licensed premises to record all instances of crime and disorder related incidents and which shall be made available to the Police and an authorised officer of the Licensing Authority on demand.
Sales of alcohol shall not include any super strength lagers, beers or ciders where the strength exceeds 6.5% ABV (alcohol by volume), for the avoidance of doubt this shall not exclude the sale of ‘specialist’ branded alcoholic beverages.
The premise licence holder shall ensure any person who may cause a public nuisance is refused admission or removed from the store by the store management (who are supported by the occasional provision of security staff.
The premise licence holder shall ensure regular Health & Safety inspections are carried out by senior management.
The premise licence holder shall adopt a ‘Challenge 25’ proof of age scheme. The premise licence holder shall operate the requirement for the production of a passport, UK photo card driving licence or PASS accredited photo card, where the individual requesting the supply of alcohol appears to be under the age of 25.
Alcohol shall be displayed away from sweets and confectionary products, so as to promote the protection of children from harm.
