ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises -
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;
(d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;
(e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).
1.4 The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.
1.5 (a) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
(b) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
(c) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request,
before being served alcohol, identification bearing their photograph, date of birth and
either -
(i) a holographic mark, or
(ii) an ultraviolet feature.
1.6 The responsible person must ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on
the premises (other than alcoholic drinks sold or supplied having been made up in
advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml;
(b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and
(c) where a customer does not in relation to a sale of alcohol specify the quantity of
alcohol to be sold, the customer is made aware that these measures are available.
1.7 The relevant person (the holder of the premises licence, the designated premises supervisor (if any) in respect of such a licence, the personal licence holder who makes or authorises a supply of alcohol under such a licence, or any member or officer of a club present on the premises in a capacity which enables the member or officer to prevent the supply in question) shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
For the purposes of this condition “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979, “permitted price” is the price found by applying the formula -
P = D + (D x V)
where - (i) P is the permitted price, (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii)
V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
[“value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994]
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
) General - all four licensing objectives (b, c, d and e) (please read guidance note 9)
The licence holder shall create and implement an event management plan (emp) to promote the licensing objectives. A final version of the emp shall be sent by the licence holder to all responsible authorities including the licensing authority no later than 14 (fourteen) days prior to the first day of the event. Any proposed revisions to the emp shall be agreed in writing with the relevant responsible authority before the master emp is updated. A copy of the emp and any linked documentation shall be kept at the event control and the content shall include: a1- site plan a2 - site plan with grid overlay to assist emergency services etc b - event traffic plan c - signage plan d - site rules e - event pass system f - event management organisational chart g - radio allocation h - medical risk assessment i - public directions to debenham hall j - risk assessment methodology k - committee contact details l - security cover m - noise control plan n - roles and responsibilities The premises licence holder shall take all reasonable precautions to minimise any noise or light pollution disturbance from the event to neighbouring properties. The premises licence holder shall complete a suitable and sufficient public safety risk assessment, prior to admission of the public, and monitor compliance throughout the duration of the event. A suitable and sufficient policy of public liability insurance shall be in place for the duration of the event, with the schedule to be provided upon request to an authorised officer of the Police or Local Authority. Adequate provision of security staff and stewards shall be deployed for the duration of the event to promote the licensing objectives and include monitoring crowd/public safety. The emergency services (Police, Fire Service and Ambulance Service) shall be notified of the event detail and the premises licence holder shall ensure that adequate numbers and designation of trained first aiders are available on site during opening hours. |
b) The prevention of crime and disorder
The premises licence holder shall ensure that: (a) excessive ordering of alcohol is not permitted once last orders have been called; (b) at all times whilst the premises are open for any licensable activity there are sufficient, competent staff on duty; (c) non-alcoholic drinks are available at all times on the premises; (d) adequate security operatives(door supervisors) licensed by the SIA and sourced from a reputable company shall be used for the duration of the event; (e) security staff manage the entry point on to the premises and exclude customers who appear to be drunk or disorderly; (f) security staff maintain good order both inside and immediately outside the premises and eject customers who appear drunk or disorderly, with due consideration to any duty of care which may apply; (g) security staff assist Police or emergency services should they be called on to the premises; and (h) all instances of crime and disorder are reported promptly to the Police and ensure that a record of the incident is entered legibly into a log book which must be kept on the premises during licensable activities A ‘Challenge 25’ policy shall be operated by the premises licence holder at the licensed premises. Any person attempting to purchase alcohol who appears to be under the age of 25 years shall be required to provide a bona fide photographic identity document to verify their age. For this purpose a passport or national identity card, photo identity driving licence or PASS approved card with hologram shall be acceptable forms of identification. |
c) Public safety
The premises licence holder shall ensure that: (a) An Event Management Plan (EMP) shall be produced for the licensable event together with suitable and sufficient risk assessments. The EMP shall include details concerning major incident planning and show stop procedure; and (b) The site shall be laid out in accordance with a detailed site plan and a copy of the plan shall be made available for inspection by the Licensing Authority or a Responsible Authority upon request. The premises licence holder shall have regard to the publication The Event Safety Guide -A Guide to Health, Safety and Welfare at Music and Similar Events (ISBN 0-7176-2453-6), or any subsequent revision thereof, when determining safety arrangements for the event. The premises licence holder shall ensure that Medical and First Aid provision shall be determined by a risk assessment of activities, and suitable and sufficient arrangements put in place at the event accordingly. All temporary electrical installations on the site shall be checked by a competent person to ensure they have been installed safely. All electrical equipment shall be installed, so far as is reasonably practicable, to prevent interference with it by unauthorised persons. The premises licence holder shall ensure that any temporary structure is erected and demounted by a competent person in accordance with the approved plans and is safe for the intended use. The premises licence holder shall take all reasonable steps to minimise the presence of glass containers on the licensed premises. The premises licence holder shall maintain a list of all food businesses involved in the preparation, handling and/or sale of food on the licensed premises and this shall be made available for inspection upon request to an authorised officer of the Licensing Authority or Responsible Authority. The premises licence holder shall, so far as is reasonably practicable, ensure that all vendors on the licensed premises carry on their own activities without compromising public safety. The premises licence holder shall provide sufficient toilet facilities for persons on the licensed premises and shall maintain those facilities in a safe and hygienic condition. Toilet facilities shall be sited in suitable locations. The premises licence holder shall provide the Emergency Services with a contact telephone number for the Event Director. The premises licence holder shall make adequate provision for waste disposal and litter removal across the site for the duration of the licensed event. The premises licence holder shall ensure the display and maintenance of signage for the duration of the event alerting attendees to the facilities, activities and general information available. |
d) The prevention of public nuisance
The event organisers, stewards and security shall be on site for the duration of the event and shall monitor public behaviour throughout the licensed event. The Event Safety Manager shall be on site for the duration of the licensed event and shall be sufficiently trained in spectator safety. The premises licence holder shall monitor the activities of the public at all times and where necessary remind them of the need to minimise any risk of public nuisance. The sound/noise levels of any amplification system used for entertainment shall be strictly controlled so that noise levels do not cause a nuisance. Use of the public address system shall be finished by 18:00hrs each day of the event except for use in an emergency situation. At all times for the duration of the event, the premises licence holder or a nominated representative shall be available to receive and respond to nuisance-related complaints. A contact telephone number shall be provided to the Licensing Authority for that purpose prior to the first day of the event. |
e) The protection of children from harm
The premises licence holder shall operate a suitable and sufficient, and clearly communicated, Lost Child Policy for the duration of the event. The member of staff responsible for supervising the lost child point shall have been adequately vetted including criminal record checks. The premises licence holder shall ensure that all stewards are instructed to be vigilant to the possibility of lost children and to promptly report to the event management any behaviour, practices or activities which that may present an elevated risk to children. The premises licence holder shall ensure that all stewards and security staff shall be fully briefed on the procedure for lost children and that an Event Control Point is available for public enquiries related to child safety. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give concern in respect of children. |
