ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises -
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;
(d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;
(e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).
1.4 The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.
1.5 (a) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
(b) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
(c) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request,
before being served alcohol, identification bearing their photograph, date of birth and
either -
(i) a holographic mark, or
(ii) an ultraviolet feature.
1.6 The responsible person must ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on
the premises (other than alcoholic drinks sold or supplied having been made up in
advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml;
(b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and
(c) where a customer does not in relation to a sale of alcohol specify the quantity of
alcohol to be sold, the customer is made aware that these measures are available.
1.7 The relevant person (the holder of the premises licence, the designated premises supervisor (if any) in respect of such a licence, the personal licence holder who makes or authorises a supply of alcohol under such a licence, or any member or officer of a club present on the premises in a capacity which enables the member or officer to prevent the supply in question) shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
For the purposes of this condition “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979, “permitted price” is the price found by applying the formula -
P = D + (D x V)
where - (i) P is the permitted price, (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii)
V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
[“value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994]

Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, the licence must include a condition that each such individual must (a) be authorised to carry out that activity by a licence granted under the Private Security Industry Act 2001; or (b) be entitled to carry out that activity by virtue of section 4 of that Act. |
Annex 2 - Conditions consistent with the operating schedule
The licence holder shall create and implement an Event Management Plan (EMP) to promote the licensing objectives. A final version of the EMP shall be sent by the licence holder to all responsible authorities including the licensing authority no later than 14 (fourteen) days prior to the first day of the event. Any proposed revisions to the EMP shall be agreed in writing with the relevant responsible authority before the master EMP is updated. A copy of the EMP and any linked documentation shall be kept at the Event Control and the content shall include:
a) Site Plan to assist in event of emergency
b) Event traffic plan
c) Signage plan
d) Site Rules
e) Event Pass system
f) Event management organizational structure
g) Event Schedule
h) Radio allocation
i) Letter to local residents
j) Medical risk assessments
k) Public directions to site
l) Risk assessment methodology
m) Committee contact details
n) Security cover
o) Noise control plan
p) Roles & responsibilities
The License holder will create a Risk management plan to cover Healty and Safety arrangments and associated risks
These will include
1 Electrical supplies to bar and staging areas
2 Movement of vehicles on site
3 Inflatable play equipment
4 Danger from collapse of temporary structures
5 Pedestrian/Vehicular traffic interfaces
6 Safety of vehicles on site (motorcycles)
7 Children coming into contact with the river at the boundary of the event
8 Lost Children
All staff at the event will be experienced and capable and a full briefing will be provided prior to the commencement of the event
Bar staff and management will be suitably qualified and experienced.
The briefing will include but not be limited to, The four licensing objectives, Health and Safety procedures, Emergency procedures, Public Safety.
The hours of the show will be from midday until 1800hrs, the advertising for the event will state midday until 1700hrs in order to allow safe dispersal from the site. Amplified music will cease at 1630hrs.
A legible notice will be displayed outside the premises indicating the normal hours under the terms of the premises licence
Clear and conspicuous notices warning of potential criminal activity, such as theft, will be displayed
There will be no selling of alcohol to drunk or intoxicated customers. Signs will be displayed in the bar area to this effect.
Properly qualified and accredited security staff will be on site for the duration of the event.
Clearly legible and suitable notices shall be displayed and maintained at the event exits, requesting customers to respect the needs of local residents and to leave the premises and area quietly. Sufficient numbers of staff shall be available at the main event exits, to ensure that customers disperse orderly and quietly.
Attendees to the event shall not be permitted to bring their own alcohol on to the site, and the premises licence holder shall ensure that this requirement is clearly advertised and notified (including website, social media and any ticketing).
All parts of the premises serving alcohol will be inspected before the commencement of the event.
No members of the public shall be permitted to enter the licensed site prior to the pre-opening inspections and checks having been completed and signed off as satisfactory by a member of the Event Management Team.
The premises licence holder shall use sufficient numbers security staff and competent stewards commensurate with the nature and scale of the event. They shall be deployed in such areas and at such levels and times as shall be determined by the premises licence holder’s risk assessment. The premises licence holder shall have due regard to any advice given by the Police in this respect.
Routes for emergency vehicle access and egress to and from the site shall be maintained as clear and unobstructed.
A suitable and sufficient traffic management plan shall be implemented by the premises licence holder. Vehicular access to and from the event site shall be clearly signed and communicated by the premises licence holder
Thelicense holder will ensure that medical and first aid facilities and provision are deployed at the site for the duration of the event.
Adequate toilet, drinking water and sanitary welfare provision shall be provided at the site for the duration of the event.
All staging, marquees or temporary structures used at the licensed site shall have suitable and sufficient risk assessments carried out. Such structures shall be erected, maintained, supervised and demounted by competent and suitably qualified persons.
A suitable and sufficient evacuation plan and procedure shall be prepared and documented for the event - covering localised, full site and major incident contingencies
Prominent, clear and legible notices will be displayed at the exit requesting the public to respect the needs of nearby residents and to leave the premises and the area quietly.
Signs will be placed in the bar area and outside advising people of the need to behave appropriatley
The premises licence holder or a nominated representative shall be on site for the duration of the playing of licensed musical entertainment and shall be available to control all music sound levels. A contact telephone number shall be provided to the Licensing Authority for that purpose prior to the day of any licensed event.
The Music Noise Level or sound configuration of amplified music shall be turned down or adjusted at the direct request (either in person or over the telephone) of an authorised officer of the Licensing Authority
Motorcyclists will be reminded that the area outside the venue is primarily residential and to reduce as far as possible any excess noise from exhausts.
The premises licence holder shall ensure that litter picks are carried out immediately following the licensed event to clear all waste/litter
"Challenge 25" encourages anyone who is over 18 but looks under 25 to carry acceptable ID (a card bearing the PASS hologram, a photographic driving license or a passport) if they wish to buy alcohol Experienced staff with appropriate knowledge will be used.
Children will not be permitted in the bar area without supervision of an appropriate adult.
The applicant is also the holder of an Enhanced Certificate within the meaning of sections 113B and 116 of the Police Act 1997.
Inflatable play equipment will be supplied and erected by qualified and experienced persons. All equipment will be built to BS EN 14960, placed on flat ground and secured in accordance with manufacturers instructions.
The river around the boundry of the event (two sides) is quite small and easily accessible to the public from the public highway. However to minimise any danger all people arriving with children will be given a safety notice to warn of the danger from the river.
