ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Any supply of alcohol for consumption OFF the licensed club premises must be made at a time when the club premises are open for the purposes of supplying alcohol, in accordance with the club premises certificate, to members of the club for consumption ON the premises.
1.2 Any alcohol supplied for consumption OFF the licensed club premises shall be in a sealed container.
1.3 Any supply of alcohol for consumption OFF the premises must be made to a member of the club in person.
1.4 The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
1.2 The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
1.3 The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
1.4 (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
1.5 The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE:
The following conditions in Annex 2 are consistent with the Operating Schedule submitted by the applicant:
2.1 The club certificate holders shall ensure that all times when the premises are open for any licensable activity, there are sufficient competent committee member on duty at the premises for the purpose of fulfilling the terms and conditions of the licence and for preventing crime and disorder.
2.2 The club certificate holders shall ensure that all volunteers will undertake training in their responsibilities in relation to the sale of alcohol, particularly with regard to drunkenness and underage persons. Records will be kept of training and refresher training. Refresher training shall be undertaken at least once every 12 months, with any new volunteer to be trained within six weeks of taking their position and prior to undertaking any direct duties in relation to the sale or supply of alcohol. For the avoidance of doubt this training may be administered in-house/on-line in accordance with the relevant criteria.
2.3 Any incidents of a criminal nature that may occur on the premises will be reported to the Police.
2.4 A comprehensive CCTV system shall be installed, operated, and maintained on the licensed premises, with a minimum of six cameras covering the licensed premises. The CCTV system shall conform to the following:
i. Camera must be sited to observe the entrance and exit doors both inside and outside the premises.
ii. Cameras on the entrances must capture full frame shots of the heads and shoulders of all people entering the premises to be capable of identification.
iii. Cameras viewing till areas must capture frames not less than 50% of screen.
iv. Cameras overlooking floor areas should be wide angled to give an overview of the premises.
v. Be capable of visually confirming the nature of the crime committed.
vi. Provide a linked record of the date, time, and place of any image.
vii. Provide good quality images - colour during open times.
viii. Operate under existing light levels withing and outside the premises.
ix. Have the recording device located in a secure area or locked cabinet.
x. Have a monitor to review images and recorded picture quality.
xi. Be regularly maintained to ensure continuous quality of image capture retention.
xii. Have signage displayed in the customer area to advise that CCTV is in operation.
xiii. Digital images must be kept for 31 days.
xiv. Police and Licensing Officers will have access to images at any reasonable time.
xv. The equipment must have a suitable export method e.g. CD/DVD writer so that police can make evidential copy of the date they require. This data should be in the native file format, to ensure that no image quality is lost when making the copy, if this format is non-standard (i.e. manufacture proprietary) then the manufacturer shall supply the replay software to ensure that the video on the CD can be replayed by the Police on a standard Computer. Copies must be made available to Police on request.
It should be noted that any retention, use or disclosure of personal information caught on CCTV must be carried out in line with the data protection principles which shall override any conflicting element of this condition.
2.5 Crime prevention posters shall be prominently displayed and maintained on the licensed premises relating to any prevalent crime and disorder issues in the local area.
2.6 No illegal drugs shall be permitted on the premises, and all hirers/users made aware of a zero tolerance to drugs on the premises. Notices shall be prominently displayed and maintained in respect of this matter.
2.7 An incidental/refusals register shall be maintained on the premises and kept up to date. The register shall be made available to an authorised officer of the Police or Licensing Authority upon request.
2.8 All fire safety appliances must be inspected annually and all emergency exits shall be kept free from obstruction at all times.
2.9 The premises licence holder shall ensure that suitable and satisfactory public safety risk assessments are undertaken with outcomes to be legibly recorded in a log-book maintained for that purpose.
2.10 Adequate provision of first aid material and trained personnel shall be on duty at the club premises during licensable activities, and in accordance with the club premises certificate holders risk assessment.
2.11 All fixtures, fittings, and equipment at the licensed premises (permanent or temporary) shall be inspected (and certificated where appropriate) by a competent person prior to use or installation. Records of such inspections shall be legibly recorded in a log-book and shall be made available to an authorised officer upon request.
2.12 Notices shall be prominently displayed and maintained on the premises requesting that attendees/users of the licensed premises leave the premises and the vicinity quietly and with respect to the needs of neighbouring properties.
2.13 There shall be no deliveries to the licensed premises between 21:00hrs and 08:00hrs.
2.14 Club volunteers on duty shall monitor the activity of patrons leaving the premises and assist with a managed departure.
2.15 The club premises certificate holder shall take all reasonable steps and precautions to minimise the risk of disturbance or nuisance to local residents caused by events or attendees at the licensed premises (whether through people noise, entertainment noise, vehicular noise, waste disposal, event set-up or breakdown, littering or noxious odour).
2.16 Contact details of local licensed taxi and private hire operators shall be made available for patrons at the licensed premises.
2.17 All doors and windows shall be kept closed (save for access or egress) whilst regulated entertainment is taking place.
2.18 Waste from the licensed premises shall be removed in a timely manner (outside of the hours between 11pm and 7am) to an appropriate waste disposal facility, to minimise the risk of public nuisance.
2.19 Lighting and emergency lighting shall be installed and maintained so as to ensure that good levels of visibility are maintained whilst the premises are being used for licensable activities. External lighting should be of such specification and positioning so as to meet this objective without causing any public nuisance by light pollution.
2.20 Adequate waste receptacles for use by customers shall be provided in the immediate vicinity of the licensed premises (including bins for cigarettes).
2.21 The premises licence holder shall adopt a ‘Challenge 25’ proof of age scheme. The premises licence holder shall operate a requirement for the production of proof of age cards such as the connexions card, citizen card, UK photocard driving licence a passport, or an official identity card issued by HM Forces or by an EU Country, bearing the photograph and date of birth of the bearer, where the individual requesting the supply of alcohol appears to be under the age of 25.
2.22 Children under the age of 16 shall not be permitted on the licensed premises during licensable activities after 18.00hrs unless accompanied by an adult.
2.23 Children will not be permitted within the kitchen or storage areas as detailed on the licensed plan.
2.24 There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
